[quote:Anonymous Coward 1233101:MV8xNDc5ODU0XzI0Mzc1NzgwXzdBMzJGM0VG] [quote:weegie] [quote:nzreva] In texas you can.
Yep. It's called a "castle law"...goes back to English Commonwealth Law(a man's home is his castle). But in most cases the intruder MUST be inside your home, not just on the property...therefore a threat to you or yours. It does get reviewed and heard by a Grand Jury...they actually decide whether or not to bring charges...usually abiding by the recommendation of the local DA. Obviously, if you threatened the dead guy last week, they're gonna be VERY suspicious.
Trespassers who come on to a persons property in Texas knowing they are unwelcome, and with the intent of committing a crime are liable to be shot dead on sight. If you come on to my property and you commit a crime, I will shoot you dead, no questions asked. Why should I risk the lives of innocent people for a drug crazed dopehead? The actual laws leave a lot of grey areas ,and subject to interpretation, but for the most part if you shoot a criminal in the act of committing a felony on your property in Texas, no charges are filed, and if they are, the jury will acquit the accused . Trespassing with the intent to commit any other crime no matter how minor is a felony. Breaking into or entering without permission of a habitation is a shoot on sight, no retreat necessary offense. If you have an intention of doing this, I recomend you find another state to do it it, because there are many here with the mindset that killing a criminal is a gift to society.
In what US states would this be legal or illegal?
Case in point, anyone who trespasses on Area-51 property is liable to be shot by armed guards. Do regular citizens have the same rights?
