You suggest that you have legal footage filmed from a public vantage point already and that it could be the 'intro' to the movie. Then you suggest that 'we' can change the plot in the 'heat of the action' and this 'intro' will no longer work. Nothing illegal if the original footage is from a public perspective (could be seen from a public area).
