[quote:Anonymous Coward 0:MV8yMDQ2MTEzXzM0Mzc5NjU0Xzc4NDZFRkJG] [quote:^TrInItY^:MV8yMDQ2MTEzXzM0Mzc5MDgyXzIwMDY0ODc1] actually wonkish what happened was the supreme court deemed it a TAX the bill was not presented to them as a tax they interpreted it as such in order to make it legal, which in and of itself is unheard of in the first place... are you looking forward to canadian style healthcare? I don't think you have any idea what that means.. but you will :damned:
1) The bill may not have been presented as a tax, but the government chose to present an alternative argument should the commerce clause justification be deemed unconstitutional, which it was; however, the alternate argument was upheld under Congress's taxing power. 2) While individuals may not necessarily agree with the court's ruling, individuals disagree on a number of its rulings, the health care law was upheld as constitutional. 3) Given that the law was deemed to be constitutional, and with the existence of the Supremacy Clause, those complaining about the law are participating in nothing more that political showboating. The matter has already been settled by the nation's highest court and iff Congress chooses to repeal it will the outcome be any different. Federal law trumps state law by the Supremacy Clause; whether or not one agrees with the clause is irrelevant. 3) We are not going to have Canadian style health care. The health care law did not set up a single payer system---Canada has a single payer system---and I am actually glad that such a system was not established as it is inefficient.
