[quote:Anonymous Coward 27352798:MV8yMDcxMjM5XzM0ODU4NzE3XzE1OTgwRDhC] Were they texting? Be sure your attorney subpoenas their phone bill for evidence. Do not be shy about going straight to the ER TONIGHT and complaining about the pain. The ER people are used to seeing people in pain so make sure you make it clear that you are in PAIN. Ask for a prescription for pain medication. You can throw the meds away later if so inclined (they are very addicting anyway) but DO accept and fill the prescription. When it comes time to sue the other party, the person with the most paperwork wins. Also, you will be re-imbursed for time lost at work, so don't tough it out by showing up at the office if you are in pain. Sorry to inform you that whiplash is MUCH worse the next day. It causes inability to focus. It also makes it hard to stay asleep. Be sure you mention these symptoms to doctors if you have them, and be sure you see the doctor actually *write down your complaints* so that when it comes time to sue you will have the appropriate documentation. MOST IMPORTANT: Get thee to a chiropractor first thing in the morning, even if you have to pay out of pocket (insurance rarely covers chiropractic, except sometimes it covers the xrays). Going to the ER is solely for the purpose of documentation that you were in pain, and to get a prescription for pain meds. The chiropractor can actually help you get well, but the sooner you see them the better for your long term situation. I'm sorry this happened to you. It has happened to me several times, no fun at all. [/quote]

I got rear ended today by some idiot not paying attention. Slammed into me pretty good. The rear of my car is pretty jacked and my back is hurting something awful. I whiplashed into my seat and was pretty out of it when the cop gathered information. So needless to say I didn't get any of the guys information but the cop said the report will be ready in 3 days. I got checked out by the paramedics and they said if my back still hurt in a couple of hours to go to the hospital.
I called my insurance when I got home, but does anyone have any advice to make sure that I don't get hosed over by the insurance companies. Should I go to the hospital just in case?
