On March 30th, 2010, Lt Col Terry Lakin publicly released a video expressing his commitment to protect and defend our Constitution. Despite what may be great personal cost, he is refusing all orders given until ‘President’ Obama proves his eligibility to hold office, by producing his long form birth certificate.

[The United States is an example to the rest of the world of a stable, civilized democratic government where all men are created equal and the rule of law is cherished and obeyed. The U.S. military teaches and promotes the rule of law and civilian control of the military to many other nations and militaries around the world. Every soldier learns what constitutes a lawful order and is encouraged to stand up and object to unlawful orders. My officer's oath of office requires that I swear to support and defend the Constitution of the United States.]

If you have already watched the Lt. Col. Terry Lakin Video, I would encourage you to spend three minutes more to watch again, paying particular attention to the last few seconds. While I was struck by his words, it was the look he made just before signing off that filled me with both admiration and compassion.

I have seen that look before. It is the look of a man who did not advance enthusiastically to a fight, but did not shirk his responsibility, when the fight was brought to him. The measure of a hero is seen in his resolve. It is the look of a man who was eager to serve out the rest of his career and retire with dignity, having served his nation with honor.

It was the look of a man who knows he has just risked everything he is, all he has stood for, worked for and loved, for his country. A man resolved to the fight, resigned that it must be him, and though he did not seek it out, he would not waver.

These are the actions of a man of honor, courage and patriotism. These are the makings of a true American hero.

By standing on his principles, Lt Col Lakin risks his freedom, reputation, career and future but his integrity will not allow him to coast into retirement pretending everything is fine. His character has compelled him to take a stand. And in his selfless sacrifice, he draws attention to an issue, which has been maligned, scoffed at, hindered and obfuscated by our politicians, our media and some of our less well informed citizens.

And so, with only the slightest tightening of his lips, the smallest, almost unperceivable nod of his head, he signals acceptance of his duty, and his resolve to see it through, to the end. He will stand up and be counted, no matter the consequences.

How many times have we asked our military to lay down their lives around the world? How many of our young men and woman have sacrificed their lives in an effort to spread democracy and secure, for other nations, democratic elections.

Recently, I watched the Iraqi elections, the culmination of years of strife, the death and wounding of thousands of our bravest men and women, the depletion of our treasury, and the loss of harmony between our citizens. It was not lost to me, while watching excited Iraqis holding up ink stained fingers, that our system of elections is sadly corrupted.

I voted in the last election, without being required to show any form of ID. Ballot machines malfunction and are compromised. Registrations are fraudulent. Now, the greatest potential political disaster ever facing our nation has occurred with a ‘President’ who refuses to release his Hawaii Long Form Birth Certificate and so many other documents that have been requested, since he began his run for office.

Still unreleased, his full medical file, his school records from Kindergarten through Harvard Law School, any thesis he may have written, his passport or Secret Service records. Why? Why is the MSM so intent on ignoring these incredibly telling actions, by first a candidate, and now a sitting ‘president’?

The standard response to anyone questioning the eligibility of the ‘President’ is to deride them as “birthers” with sneering contempt. This ridicule is meant to demean and demoralize anyone asking perfectly legitimate questions.

Anyone labeled a “birther” is then perceived as either an ignorant conspiracy theorist or a miserable racist who fears having a black man in the White House. In truest Saul Alinski style, ridicule is used to control, silence and defame. But the overuse of ridicule seems to be losing its effectiveness, as Americans of all classes, races, and levels of education, embrace the deeper truth.

He, who has nothing to hide, hides nothing.

It appears to me that ‘President’ Obama displays what is known as ‘guilty demeanor.’ By his actions, he displays his guilt. This, of course, is just my opinion, since we simply do not know enough about him to know either way. That, of course, is the problem.

Is Lt Col Terrence Lakin just another ‘right wing, racist, uneducated, birther’? Surely his impeccable reputation and qualifications give credibility to his stance.

What would compel a man with 18 years of honorable service and an impeccable record, to risk everything for which he has spent a lifetime working? Just imagine what his friends, family and peers must have said to him. Imagine what his own sense of self preservation must have whispered, in his soul, during the quiet, dark hours of night, when the weary spirited contemplate unknown futures.

Although I do not know him, I feel safe in saying he must have done some serious soul searching, before inviting his own court martial. I am sure he took every avenue available; until it became clear there was no resolution without significant action.

What is this man willing to sacrifice personally, in order to protect our country and our Constitution? It would appear that this action will cost him dearly. What he hopes to gain is justice for our nation and for all of her citizens.

What has President Obama to sacrifice by providing a simple document? One would think a Commander in Chief would see the benefit of a faithful and trusting military. Why refuse to ease the mind of so many of our citizens and our military, whom he has asked go into harm’s way? Is it really too much to ask that he unseal his birth certificate for the sake of the nation?

One can only assume that he is so arrogant and stubborn that he will not bend, no matter the consequences. If that is the case, it is a dangerous character flaw.

Or one must believe he has something to hide, which is of such magnitude, he would risk the constant onslaught of lawsuits, the distrust of military members, and the speculation of the masses of Americans who simple cannot reconcile his position. This would also be quite a dangerous possibility.

To those in government who know why this situation has occurred, or suspect there is fire, where so much smoke rises, but haven’t the courage to demand this issue be resolved, may God forgive you your moral cowardice.


I continue to hope that just one member of the media, one decent journalist with integrity, will begin the process of vetting this ‘president’ finally. The media will have to live with the consequences of their blind devotion to this president. Americans have lost faith in journalists, as well they should. Perhaps one day, a journalist will give this matter fair airing and let the chips fall where they may.

May God bless and keep Lt Col Terry Lakin. May the American people recognize his dignity, integrity, sacrifice and bravery.

May President Obama be compelled to do the decent and honorable thing by providing critical documentation to a weary, worried, stressed nation and military.

May the Military justice system respect the faithfulness that Lt Col Lakin has shown, to his oath, and our Constitution.

May God Bless America and protect her in this time of great uncertainty and strife.

Lt. Col. Terry Lakin is the highest-ranking and first active-duty officer to refuse to obey orders based on President Obama's eligibility.

A decorated Army surgeon who is refusing to follow orders because of the president's decision to conceal documents that could show his eligibility to be commander in chief is telling the military to bring it on – by missing a deployment due date yesterday at Fort Campbell, Ky.

Lt. Col. Terry Lakin is facing imminent court-martial charges in the wake of the Army's demand he report for a Middle East deployment, and his decision to refuse orders until there are answers to questions about President Obama's eligibility.

"He has been informed through official challenges that he will be charged soon with missing movement and conduct unbecoming an officer," according to a statement released last night to WND.

The information was from Margaret Calhoun Hemenway, who is acting as a spokeswoman in the case involving Lakin.

Lakin is not the first military officer to point out that Obama has not documented his eligibility to be president and note that officers have an obligation to refuse to obey orders they believe are illegal.

Others have included Army doctor Capt. Connie Rhodes and Army reservist Maj. Stefan Cook. But Lakin is the highest-ranking officer to raise the question.

His challenge to the president was posted online:



Hemenway told WND Lakin decided to abide by his announced decision not to obey military orders, "including orders to deploy for a second time to Afghanistan, and refused to be dispatched to Fort Campbell ... in preparation for the overseas assignment.

"LTC Lakin's own deployment orders to Afghanistan included a requirement for him to bring 'copies of his birth certificate,'" the statement from Hemenway said.

WND has reported on a multitude of cases that have been brought over the issue of Obama's eligibility. Some are by critics who have doubts about whether he was born in Hawaii in 1961 as he has written, and others are from those who question whether the framers of the Constitution specifically excluded dual citizens – Obama's father was a subject of the British crown at Obama's birth – from being eligible for the office.

The issue has prompted a number of state legislatures to work on proposals that would require presidential candidates to submit proof of their eligibility. And a similar proposal has been introduced in Congress by Rep. Bill Posey, R-Fla.

The Constitution, Article 2, Section 1, states, "No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President."

However, none of the cases filed to date has been successful in reaching the plateau of legal discovery, so that information about Obama's birth could be obtained.

The White House has not replied to numerous requests for comment.

Lakin's YouTube statement, now viewed by more than 100,000 people, confirmed he was "inviting his own court-martial" over his public demand for confirmation of Obama's eligibility.

He said, however, he was compelled to act as he did because of his oath as an officer to "support and defend the United States Constitution," including the article demanding that only a "natural born citizen" can be president.

"As LTC Lakin faces court-martial, the preponderance of anecdotal information falls heavily on the 'born in Kenya' side of the debate; it will be critical to the LTC's defense that actual records are subpoenaed to permit him a fair trial. The American military, held so highly in the public's esteem, must protect this officer's right to self defense," said the statement from Hemenway.

The Safeguard Our Constitution website, run by the American Patriot Foundation, already was raising funds for his legal defense.

According to a report at Military.com, a spokesman at Fort Campbell said Lakin did not report and was not expected to.

The report explained that Lakin essentially was daring the Army to bring charges. Until now, the Army had taken no action and appeared to not want to do anything.

Lakin also posted online a letter explaining his reasoning. The Safeguard Our Constitution website describes how Lakin tried through his chain of command and his congressional office to get answers to questions about Obama's eligibility.

"You serve as my commander-in-chief. Given the fact that the certification that your campaign posted online was not a document that the Hawaiian Department of Homelands regarded as a sufficient substitute for the original birth certificate and given that it has been your personal decision that has prevented the Hawaiian Department of Health from releasing your original birth certificate or any Hawaiian hospital from releasing your records, the burden of proof must rest with you," he wrote.

WND has reported that the controversy raises the prospect that the government ultimately may not want to pursue a prosecution because a defense attorney could demand in court proof that the orders are issued by an eligible president.

One of the organizers behind the Safeguard Our Constitution website, serving in emeritus status, is John Hemenway, an attorney who previously fought in the U.S. court system on behalf of a retired military officer, Gregory S. Hollister, who also questioned Obama's eligibility.

The case ultimately was dismissed by Judge James Robertson who ruled that the dispute had been "twittered" during the 2008 election campaign.

In that opinion, Robertson sarcastically wrote: "The plaintiff says that he is a retired Air Force colonel who continues to owe fealty to his commander in chief (because he might possibly be recalled to duty) and who is tortured by uncertainty as to whether he would have to obey orders from Barack Obama because it has not been proven – to the colonel's satisfaction – that Mr. Obama is a native-born American citizen, qualified under the Constitution to be president.

"The issue of the president's citizenship was raised, vetted, blogged, texted, twittered, and otherwise massaged by America's vigilant citizenry during Mr. Obama's two-year-campaign for the presidency, but this plaintiff wants it resolved by a court," Robertson wrote.

The judge also suggested sanctions against Hemenway for bringing the case, and Hemenway responded that process then would provide him with a right to a discovery hearing to see documentation regarding the judge's statements – not supported by any evidence introduced into the case – that Obama was properly "vetted."

Hemenway warned at the time, "If the court persists in pressing Rule 11 procedures against Hemenway, then Hemenway should be allowed all of the discovery pertinent to the procedures as court precedents have permitted in the past.

"The court has referred to a number of facts outside of the record of this particular case and, therefore, the undersigned is particularly entitled to a hearing to get the truth of those matters into the record. This may require the court to authorize some discovery," Hemenway said.

WND columnist Vox Day earlier wrote about this very scenario, calling it a "Get out of war" free card.

The comments followed the case of Cook, the reservist who challenged his deployment orders over questions about their legality under Obama.

"Rather than contesting the suit," Day wrote, "the Army took the highly peculiar step of revoking the major's deployment order, suggesting that the Pentagon generals are not entirely confident that they can demonstrate the legitimacy of their purported commander in chief.

"The Pentagon's decision to back down rather than risk exposing Obama's birth records to the public means that every single American soldier, sailor, pilot and Marine now holds a 'get out of war free' card."

Obama's actual response to those who question his eligibility to be president under the Constitution's requirement that the U.S. president be a "natural born citizen" has been to dispatch both private and tax-funded attorneys to prevent anyone from gaining access to his documentation.

Besides Obama's actual birth documentation, the still-concealed documentation for him includes kindergarten records, Punahou school records, Occidental College records, Columbia University records, Columbia thesis, Harvard Law School records, Harvard Law Review articles, scholarly articles from the University of Chicago, passport, medical records, his files from his years as an Illinois state senator, his Illinois State Bar Association records, any baptism records, and his adoption records.

Obama Continues to Refuse to Release Birth Certificate;
Army Doctor’s Pentagon Access Pass Revoked; Computer Seized

Washington, D.C., April 13, 2010. Army doctor Lt. Col. Terrence Lakin yesterday met with his brigade commander, Col. Gordon R. Roberts, who proceeded to read LTC Lakin his Miranda rights, and who informed LTC Lakin he had the “right to remain silent” because LTC Lakin is about to be charged with serious crimes. Col. Roberts was at age 19 awarded the Congressional Medal of Honor, the only recipient of the nation’s highest honor currently on active duty in the Army.

LTC Lakin had previously been ordered in writing to report yesterday to Ft. Campbell, KY and then on to deploy for his second tour of duty in Afghanistan. Lakin refused to obey these orders and instead came to work yesterday morning at the Pentagon. Late yesterday afternoon he was confronted by his brigade commander.

Before the meeting was over, LTC Lakin’s Pentagon Access Pass had been revoked, and his laptop computer was set to be confiscated.

The message to LTC Lakin is clear; through official channels, he was informed yesterday that he will shortly be court-martialled for crimes (specifically, missing movement and conduct unbecoming an officer) that for others has led to lengthy imprisonment at hard labor.

Lakin has announced in a YouTube video that has now been viewed more than 110,000 times that he considers it his duty to refuse to obey orders that would be illegal if President Obama is ineligible to hold office.

Meanwhile, cries mount for proof of that eligibility, but nothing has been forthcoming. The Obama campaign at one point released a copy of computer-generated abstract of information purportedly in Hawaii's records system, but the source of this information is unclear and need not have been a birth certificate issued contemporaneously and signed by the doctor who attended the birth. Even the document released was only a copy, and the version printed in the Los Angeles Times on June 16, 2008 is on a form only in use since late 2001. Even as it is, the document contains a warning that it is merely “prima facie”--threshold, rebuttable and thus inconclusive --evidence of birth, and the copy the Times printed mysteriously has the certificate number blacked out, thereby rendering the document unusable according to language on the bottom.

Given the seriousness of the offenses with which LTC Lakin is about to be charged, the American Patriot Foundation today renewed its plea for donations to its legal defense fund for LTC Lakin. Details are available at APF's website, www.safeguardourconstitution.com.
