After browsing this document, it appears the Turkish ship gave up it's right to peaceful passage when it declared it's intent to guard the other ships, just my layman opinion, and it doesn't mean much.

You would have to know the exact coordinates of the ship, at the time of the incident to know the specific area of law to apply to this case.

you girls are confusing TERRITORIAL Waters with INTERNATIONAL WATERS.

there is no need to have 'right of passage' in international waters.

'right of passage' only is valid in TERRITORIAL waters.

Like I said, you need to know exactly where the ship was to decide which set of laws is applicable.

Most of the sections I've read so far, have the same concept to them, a ship is peaceful as long as it is declared as so, and acts as such. When it acts or declares it's intentions to be other than peaceful, ie gaurd ships threatening to deliver unknown goods to an agitated part of your own country you would naturally loose the right of peaceful passage.
