If the State Government has precedent over the Federal Government, then why aren't the state officials in the Gulf taking control?

If the State Government has precedent over the Federal Government, then why aren't the state officials in the Gulf taking control of this situation?

It seems our governors could over ride any BP official (thug) in providing public health and safety to their respective citizens by:

1. allowing intervention from animal rights activists in helping our dieing sea-life

2. allowing the citizens to volunteer in the cleaning of the beaches

3. allowing citizens to report and video any activity in the Gulf

Furthermore, the Universal Declaration of Human Rights states: "Everyone has the right to freedom of opinion and expression; this right includes freedom to hold opinions without interference, and impart information and ideas through any media regardless of frontiers"

the leak is 25 miles off the coast in US territorial waters the states control starts at the shore line only
