1. did you get a prenuptial agreement (no I'm guessing)

2. Do you live in a community property state? (yes, I'm guessing)

3. Is there a minimum length of time a couple must have been married for the wife (without children) to be ABLE to demand 50% of your assets in a settlement? (I know there are minimum lengths of time one must be married in order for either partner to expect any alimony.)

4. Are you in a better legal situation because SHE left you, you did not leave HER; you did not abandon the marriage, she did.

5. Is there ANY property of yours that is ALSO in her name? (for example, are you both on the mortgage to your home, are you both on the title to your car)

6. Do you have any children from a previous marriage? They have a stake in what happens to you financially and this woman who is soon to be your x-wife.

7. Did you have a will that had been drawn up prior to being married to her? If so, did you change it to make her a beneficiary in the event of your death? (This would show intention on your part to leave her with your assests.)
If you do have a will, but you never changed it to make her your beneficiary, I would think that works in your behalf.

8. Check whether she has pulled this before with some poor fool ahead of you (possibly abroad). Maybe this is her M.O. Maybe she goes around marrying guys, staying married for a short time and then takes them to the cleaners. Maybe???
Talk to her "oldest friend" that you know of and pump that person for info about her past.

9. The simplest solution is for you to claim alienation of her affections and prove that she carried on an extra-marital affair at some point during your short marriage.
