Gov. David A. Paterson renewed his pledge Thursday to start collecting taxes on cigarettes sold by Native Americans, acknowledging that "violence and death" could result.

During an interview on a New York City radio station, Paterson, said the state is moving ahead with its controversial plan to start collecting a $4.35-a-pack sales tax Wednesday on Indian cigarettes sold to non-Indian customers.

"There will be quite an uprising and protest to this," Paterson said, "but I am going to maintain this policy."

He also noted State Police warnings about the potential consequences of his decision.

"This is a very dangerous situation," he told WOR Radio. "There is a, I think, high alert. The State Police tell us over and over again that there could be violence and death as a result of some of the measures we're taking."

Paterson said state troopers will be kept off the state's Indian reservations to avoid conflict and indicated the taxes will be collected from wholesalers sending cigarettes to the tribes.

In 1997, the last time the state tried to collect taxes on Indian cigarettes, a confrontation between Indians and state troopers shut down a 30-mile stretch of the Thruway south of Buffalo.

In 1992, during another tax dispute, burning tires also closed part of the Thruway.

Indian businesses have a long history of refusing to collect the state's sales taxes, citing their sovereignty and treaties with the federal government. The state is projecting $150 million in new revenue from the tax.

As Paterson renewed his pledge to tax Indian cigarettes, opposing factions in the dispute took their cases to the public.

Leaders of a statewide business coalition held a news conference Thursday in downtown Buffalo, calling on state leaders to stick to the collection game plan.

The native american's also sell gas w/o taxes in that area.

I do not see how the American Government can impose taxes when it's not their land.

Should be interesting.


The problem is gas seeping into the ground w/c happened at one or more of the Rezs. The owner grabbed the money and took off. Well, someone had to cleanup the spill and contaminated land, it was the state.

Need to be more careful with stations.

Yes they will be the wholesalers collecting the taxes on the ciggs they deliver to the rez. So if they want Marlboro's and all of that...they will have to pay the taxes...no other way to get them. Unless you smoke one of the native brands like I do...I think the government can't touch those...

"Blinky" Paterson is being pressured, as a recovering drug adict and pot smoker he knows the risk. The Federal Government is pushing the incroachment upon the treaties. They fail to think about the facts that if you mess with the Seneca Nation in NY you mess with the rest of the Seneca Nation in many other states. The rest of the people who are non native had better be prepared to choose a side. "Break a treaty you break the Law" What's that smell?



And if you mess with the Senecas or any Indian Nation, you mess with ALL OF US> Dont think the Chippewa and Lakota and so on wont be behind you, all of one heart and one mind.

To see what will happen just google "OKA reservation vs. Canadian government". Oka Rez straddles both US and Canada. Same with Wounded knee...we dont just write our representatives about stuff, we die for our rights and did so recently. We know the average guy cant do this and just ends up taxed to death. But that is not our way...we used to give in and lost everything and got killed...now we resist and have nothing to lose and still get killed but it does make some changes.

Im getting to old for another OKA or wounded knee but if my husband and I can go there and do something we will because if we dont fight, stand up for and are willing to die for our rights, our grandbabies will have to or have none.

Pot is illegal to grow even on the rez...federal bullshit ya know? The DEA or FBI can come on the rez and arrest anyone for a federal crime...same with the state police. When you call the cops if you live on the rez first the marshalls show up and then the state police...and if the marshalls can handle whatever is going down...the state police lets them take over...

Many people say that they were gonna quit smoking when that tax went into effect...guess what? many of my customers still are paying 10.00 a pack...The government knew they would.

Interesting you say that...I manage a convince store off the reservation...and when that tax went into effect people were pissed...but they still had the rez to go to...and now they wont. Many people say that they were gonna quit smoking when that tax went into effect...guess what? many of my customers still are paying 10.00 a pack...The government knew they would.

This is a huge pissing contest.

The Oneida - already own a manufacturing company - I think they are making NIAGRA cigarettes and they suck - and if you buy them at the casino - they still cost almost $5.00 a pack because they told the state that they would be "competitive"
in their pricing.
Gas BTW is just about the same as you can get on the "economy". They just aren't paying the taxes. As I live "here" I sometimes buy gas there and "it doesn't seem to "go" as far"" Could be my imagination.

The Seneca - make great cigarettes - no additives - which you cannot buy anywhere - but on a reservation.

I worked at TurningStone(5 yrs) (DO NOT FEEL SORRY FOR THESE GUYS!)
I got my cigarettes on line from a Seneca Reservation.
Again - you cannot (at least around here - (I hate to make a "blanket" statement)) buy them "on the economy". I worked at TurningStone - it was cheaper to get them from the Seneca Reservation.

THEN - we had FSC - Fire Safe TOXIC cigarettes. The reservations were the last to go with that (at that time the Oneida were not making their own).
(Oh and NY State was the FIRST to start that crap.)

So I started rolling my own and getting native tobacco (no additives) from the same Seneca reservation. (They are ALL ABOUT customer sevice BTW) - Then THE PACT ACT. Not just a NEW YORK thing - OBAMA did that.

You know - what "we" were doing" - ordering cigarettes on line - was legal - we we getting a product that was not available anywhere else. WTF? Now - if you want Seneca cigarettes - you have to live near a Res and get the FSC ones and still PAY THE TAX - Oneida put a "Casino TAX" on them.

BUT THE BOTTOM LINE is - Pissing Contest! The State of New York will do WHATEVER to get THE MONEY. Ya Like ANYBODY "IN CHARGE" cares about blood and bodies. Hey this GLP - we don't KNOW that?

IT'S not just about tobacco - it's not about treaties - it's about WHO CAN WE F--K and where can we get MONEY.
This is just PART of the WHOLE.

But I am 100% behind the Senaca - hang tough guys.
Somebody has to.
