not all at once and he isnīt losing his daughter, he gets her any time he wants her, joint custody which means neither of us pays child support. we both support her independantly

its called being an adult

It all depends on what state you live in.
Some state require that as long as an employee is not fired for misconduct they are required to pay them for any unused vacation time.
Check your states labor laws.

157 is correct. He needs to call the labor board. Iīve dealt with them before and they were pretty good - they really donīt put up with employer bullshit. They see people getting fucked over day in and day out and they like the chance to fix it.

I was under the impression that accrued vacation was money owed to you. You earned it as part of your salary.

There are a number of variables. State law; the companyīs written policy if it had one; whether he was working under a contract; the reasons for for which he was terminated; etc. If it was a large amount, your ex should see an attorney. Otherwise, as mentioned, the labor board or small claims court or both. Many attorneys will give you an initial consultation for a reasonable price and let you get a realistic idea of your options under your stateīs laws in this sort of dispute.

Each company is subjected to a yearly audit.

This might go world wide?

So any balance owed to him, must be paid back in a reasonable amount of time.

He has the right to go to the employee section of this company and ask to see his payout account, or what the company owes him.

This is not a polite request, but the law.

If this company is caught hoarding monies of the employees, them the Scottish version of the IRS, "Iīm guessing this is where you are", would take a very dim view of this.

This is not a buddy buddy type of affair, but what is owed to him in the accounts in his salary paid out by the company.

They have to show him this, If they donīt, he can report them.

i know that the laws here make it so you have to be specific. if you put it as personal days then you are not entitled to the payout and if its stated as use it or loose it then its the same thing, they donīt have to pay but in his employee hand book it does say that it is accumulated vacation time.

he asked this boss about it when he received his last check and the guy said he would get it too him on the next payroll run but hasnīt done so. now the guy wonīt return his calls.

Some employers are just "motherfucking crooks" HM. And they keep their elite scumbags of politicians, attorneys and judges in their hip pocketīs if you know what I mean.

I had a guy use to work with me fired from my company and he complained the boss lied on him at his unemployment hearing so he couldntī collect unemployment. But the boss even though a bastard might have been telling the truth.

Years later I ended up working for the guy I knew who had been fired, he had his own small company. Then he found out I was starting my own company on the side and fired me. He lied at my unemployment hearing so I couldnīt get unemployement while I was starting my business. Also, he owed me about $5000 and did not pay me when he fired me. The unemployment office gave me about $1500 while the hearings were going on and to this day they still want me to pay even that back.

So you see. Some work under the principle "fuck unto others before they fuck unto you".

Whereīs Bullshit! when I need him.
