Greetings,

This will lead to collapse and Martial Law. The Banks do not own the homes but the banks use the value of the homes to conduct business in investments. The value that secures the investments go to zero. Any money paid out on said investments would likely be due back to the payer.

The Banks will attempt to call in as many business loans as they can quickly. Much of their value out is backed by zero.

The entire system, which is already quite fragile, will fall, and mark my words friends, followed by Martial Law.

This is a highly complicated matter. This will not be easily resolved but resolved it will be. And the people who got foreclosed on or are in the process of being foreclosed on probably should hold off popping the champagne bottles. This is just a delay of a rightful execution.

If you got/get foreclosed on, it's probably for the right reasons (like not fulfilling your obligation) but executed by the wrong party.

The 'fraud' boils down to a technicality. The company who is collecting on your mortgage isn't the actual owner anymore, but someone does. You do have an obligation to pay your mortgage. The question is, who is eligible to collect it.

For people who do pay their mortgage it's fair to question who holds their mortgage in order to pay off your mortgage to the rightful owner.

For people who can't pay their mortgage it's unfair to jump on this bandwagon. Basically, those people don't meet their contractual commitments and commit fraud themselves because even if the rightful owner shows up with their contract, they still wouldn't/couldn't pay.

If you took on a mortgage, you should be ready to pay for it when the rightful owner shows up.

I think the majority of people who got foreclosed on or are in the process of being foreclosed on are hoping to take advantage of this technicality to reverse a bad decisions They made in the past. These people signed contract who shouldn't have and now they try to weasel their way out of it.

I tend to agree on the fact that in this underregulated market loan sharks played a trick on suckers who thought that their unbacked property would always increase in value. Especially those NINJA loans are unforgivable.

Having said that. Two parties made a commitment and both of them should uphold their contractual commitments.

I think this will be solved and the rightful owner will show up to collect. The holder of these securities is the owner of your mortgage. It just so happened to be, that the government bought a shit-load of these securities. They wouldn't even have to dismantle the securities to find out what's in them exactly.

So in conclusion... if you aren't able to meet your contractual commitments anyway, don't get your hopes up.

The mistake banks made was repackaging and sell off bad loans over and over again. It doesn't change the fact that MOST of these people owe on their homes and they need to pay up.

Lots of stuff in life is unfair. It would be nice for things to be unfairly good for once, usually it goes the other way in society! People aren't about to go out of their way to be extra fair to banks right at the moment, and they have every good reason for this feeling.

If the banks are allowed to negate 400 years of contract law just because it is "inconvenient" and would cost them "internal administrative costs" ... then the foundation of the entire commercial law legal system in the US is GONE.

It then becomes a Free For All as to who has the biggest lobbying dollars since contracts cease to mean anything (sounds like what happens in a third world crooked country to me)

The Court isn't ordering anything outlandish or what hasn't been required for the last 400 years in the US and British legal system.

The fact is it is not only the folks losing their homes but also those who have never missed a payment nor been a day late. When it becomes apparent the banks cannot legally establish title folks will start not paying as they watch neighbors "get their houses without paying".

The Banks and other Major Corporations run the Government. It is "their guy" who has his finger on the button.

The President of The United States has a job that pays $400,000 per year plus $50k in expenses. Yet, we see MILLIONS spent on trying to get Mr X elected. Mr X often spends MILLIONS of his own to secure a < half a million dollars a year job.

They have kept the people roughly divided down the middle via Politics. I fear it is beyond the time when they can be fought and this came about by our own division.

Only in a land of divided people can such a thing take place as has. They toss us political bones to fight over while they are about their business.

It is they who will not go quietly into the night and it is they that have the technology to destroy us all.

The payments people made on their mortgage to those who didn't hold the contract, collected this unrightfully. They are legally not the ones who should have collected the payments and are not eligible to foreclose on their homes. Only the rightful owner of that contract is.

The money which has been payed to the unrightful creditor should go to the rightful creditor, the owner of the actual contract. The rightful creditor of these contracts would have the ability to claim those payments from the unrightful creditor or from the people who withhold payments until this is sorted out. If the rightful owner of these contracts show up to collect and people can't or refuse to pay, the rightful creditor would have the power to foreclose on the property.

Don't mind me saying this but it seems to me that a lot of people are hoping they can't find the rightful owner of their contract so they could gain a property for free.
