You must establish INTENT.

The long term fix takes a few months...

so it's important to establish your INTENT... ASAP..

so if you end up in court before finishing the "long term fix"

Of course the courts can do this. The Constitution does not apply as most all Americans are US citizens under the 14th Amendment. Accordingly they are legal entities under private law wherefore the Constitution does not apply.
