On a 106-degree May afternoon in 2003, government agents raided several establishments belonging to Southern Nevada businessman Robert “Bobby” Kahre. With guns drawn, officials held more than 20 handcuffed workers in the sun without water as agents collected records and other materials.

Kahre hadn’t committed a crime. He had upset the Internal Revenue Service by paying his workers based on the face value of gold and silver coins, versus the market value in the Federal Reserve system (the value of the coins in U.S. paper dollars). Even though the coins were in circulation, displayed a face value, and were regulated by Congress, the IRS’s confusing and endless tax code did not determine how to handle these gold and silver coins if used for payroll. The tax code only references dollars. It does not distinguish between coined money and paper money.

Kahre didn’t opt for the precious metal bullion system without first doing his homework. He consulted monetary experts, engaged in extensive research, and even met with congressmen. Back in FDRs day he only managed to steal maybe 50% of the gold in the US and probably considerably less than that. Still the biggest thief of his day, and he also used treasury employees to accomplish his theft.

But today, there are much more subtle/obtuse ways to pry those shiny metallic medallic pieces from your grasping little plebe hands. You have to know it will happen. Sorry but you know, we cannot allow internal competition to the Federal Reserve Note. We run our nation on debt, and pay our enforcers in paychecks denominated in that debt.

Ah but I hear you may qualify for a superior exchange rate for your contraband if you sign up for fiduciary-military service. And well, after the gold and silver is taken, you might be a partisan so we will have to watch you closer. It's easier to just snap your heels together and say "Yes sir! May I please join the fight against the Chinese currency manipulators?!" ...There will be incentives if you do.

Through his lawyer, Noell P. Tin of Charlotte, North Carolina, Liberty Dollar founder Bernard von NotHaus, convicted of counterfeiting two years ago in federal court in North Carolina but still not sentenced, has filed a motion for acquittal or retrial. The motion's preface puts the situation well:

"Mr. von NotHaus stands convicted of various statutorily-defined forms of counterfeiting. The irony of this is that if anything is clear from the evidence presented at trial, it is that the last thing Mr. von NotHaus wanted was for Liberty Dollars to be confused with coins issued by the United States government. That would, as witness Vernon Robinson testified, have defeated the whole purpose -- to demonstrate to citizens and communities that there is a way to engage in commerce and not use the Federal Reserve system.

"Whether writing scholarly papers on value-based currency, attracting media attention, or selling T-shirts saying 'The Fed Can Bite Me,' Mr. von NotHaus has always operated out in the open. His intention -- to protest the Federal Reserve system -- has always been plain. The jury's verdict conflates a program created to function as an alternative to the Federal Reserve system with one designed to deceive people into believing it was the very thing Mr. von NotHaus was protesting in the first place.

"Whatever one's opinion about the merit of value-based currency, the fact remains that the Liberty Dollar was not a counterfeit and was not intended to function as such. The verdict is a perversion of the counterfeiting statutes and should be set aside."
