Utilities usually run where the basketball pole was placed. Maybe there is more to the story. Maybe the city is upgrading its infrastructure; like replacing sewage lines or something. They said the pole was there for 60 years.

There has to be more to the story here. However, kudos to the couple trying to defend their property and freedom of speech rights.

After much research I found out the whole story and its not exsactly what you see here.

They were given 2 notices to take down the hoop. They should not have lied tho and told them they could keep it -it just agravated the situation..they did by the way get there hoop back. Just thougth Id let you know the whole (truth)

This is a municipal matter and the same thing would probably happen in Canada or Europe or anywhere else to people breaking city ordinances.

Besides zoning restrictions the guys BB pole was in the easement of the road and that is not his property. It belongs to the city.

Worse than that are home owners associations. I have a friend that installed stain grade exterior front doors on his house and he got taken to court and sued and ended up painting his doors to be in accordance with the covenants.

Still they should not have just gone and extracted the pole IMO although some jurisdictions will do that and he had some warning.

In reality they probably saved him thousands of dollars, because the alternative would be a lawsuit City vs Joe Blow for being stupid.

Cities set up municipal codes and zoning laws for a reason, and kids playing BB in the street is not a good idea anyway.

I sorta agree with you. I think parents that allow their kids to play in the road should face a $5000 fine each and every time their little skutter runs out in the road.

I raised two kids and they never played in the road. I never let them. The one time they tried I caught them and whupped their asses for it.

If you love your children, then allowing them to play in the road is a very, very bad idea. Cars should not have to go slow and look out for kids that have no business in the road.
