In theory, yes. But you better call the Sheriff dept if you are arresting a city cop.

In practice you will get tased, arrested, held for 72 hours and fucked with fir the rest of you time in that city.

LOL. You can try, but yeah, I imagine a good tazing would fallow. My uncles the fire cheif for the 2nd largest city in Illinois. I could drop my last name and be like "im arresting you Offici-mer" And Id still get tazed, so good luck.

I remember watching a news story showing a old man coming into a store and started yelling at a cop that parked in a handi-cap spot. The cop clubbed him and arrested him.

The crime? Creating a public disturbance.

I work with a guy that had a altercation with a guy in a bar. It was over but a little bit later the guy came over and stuck a knife in my co-workers leg. It turns out the guys brother was a cop in the town and prosecutor wouldn't file charges, he called it mutual combat. Not only can you not arrest a cop, but their family is immune also.

You would have to have a large force of people to back you up.

But in theory if he/she was breaking the law I am sure you could, but be prepared for retribution on your ass from all the cops buddies.

Maybe using common law would be the way am not sure you yanks can use it you might have your own variation of it.

Here in the UK some people tried to arrest a judge.

As long as he is not in function (in uniform working) at the time, yes you can. At least here you can. There just people with a function in the justice department. Of duty there just normal people and you can make a citizens arrest if needed.

If you want to know for sure, call a local lawyer and ask him.

In the UK you can't make a citizens arrest unless the crime carries a prison sentence of over 6 years.

So unless you see the police rape, murder or import a few tones of coke you can't do much.

It is unfortunate that most people feel that way about cops, but i do empathize with your comments...for I am a 12 year veteran. It is sad when our society has no faith, trust, or respect for our protectors in "blue".

Obviously, I am not perfect but at least i sleep well at nights knowing that i have done my job well and treated my fellow Americans (or Non-Americans) with my deepest and heartfelt respect. Please believe me when i say that not "ALL" cops are as bad as most people think. Most of my beat partners really care about people even if they have committed a crime. In our view, the people we arrest are not necessarily "bad" people, but made "bad" choices. Unfortunately, we have no choice but to take action and "action" really depends on a person's willigness to comply. This is when dipolmacy is the most important; however it doesn't work all the time, especially if he or she lacks rationality through intoxication.

As for cops and their families being immune from justice...this is certainly not true in all cases. I always tell my family (especially my sons) that if they ever got in trouble with the law they are not to call me to get them out of it. This may seem cold to some, but they should be accountable for their actions like everyone else.

In most counties, if you do have a grievance with a certain police officer it is recommended that you file a complaint with their Internal Affairs or the Police Commission. If nothing else works, then your local media could help in exposing it. Police Officers should never be above the law...Period!!

The way i see it...I dont serve my Sergeants...or my Lieutenants...or my Captain...or our Chief, Mayor, or President. I serve the American People...End of Story.

The law makes no distinction between a police officer or a citizen when it comes to making a felony arrest here in Texas.

Anyone can apprehend a felon, and no on is immune from arrest or the law.

When a citizen makes an arrest, the citizen is required to deliver his complaint to the sheriff of the country he is in, along with the arrested individual.
Evidence of wrongdoing or probable cause must exist to arrest a felon. Witnesses are an absolute necessity if you're going to attempt to make an arrest of a police officer in uniform, because for obvious reasons you're going to need them.

Citizens can use whatever force is necessary to effect an arrest, but can only use a proportional response to danger to himself or another. That is to say if the perp pulls a gun, you can of course shoot him, but you can't pull a gun on an unarmed man. Police are always armed , so to make an arrest you will obviously have to use a gun.

On the other hand, if any person including a police officer tries to arrest a person where no wrongdoing has occurred , no warrant has been issued, or no legitimate probable cause exists to make an arrest, that individual can resist that false arrest using whatever force is necessary. This makes things dicey for the aggressive ,overzealous cop in Texas, because he is always armed and his actions make him liable to being legally shot if he tries to affect an illegal arrest. these laws have been on the books in Texas since it was a country.
