Corps delays third breach after exhausting explosives supply

"SIKESTON, Mo. -- A third levee breach planned for Tuesday is being delayed by at least 24 hours because the U.S. Army Corps of Engineers used too much of the explosives on the first two detonations and do not have enough for the third breach yet, corps officials said at a news conference Tuesday evening.

Col. Vernie Reichling, who heads the corps' Memphis District, said they discovered the "potential issue" Monday night after executing the first breach at Birds Point in Mississippi County. The problem was exacerbated Tuesday after the second blast near New Madrid, Mo.

"We saw that we were potentially using more of the slurry mix than we had anticipated," Reichling said. "This comes as we are executing a plan that was hatched 30-some years ago and we are implementing it for the first time. So there has been a learning curve."

Missouri levee blast eases threat to Illinois town

The dramatic, late-night demolition of a huge earthen levee sent chocolate-colored floodwaters pouring onto thousands of acres of Missouri farmland Tuesday, easing the threat to a tiny Illinois town being menaced by the Mississippi River.

But the blast near Cairo, Ill., did nothing to ease the risk of more trouble downstream, where the mighty river is expected to rise to its highest levels since the 1920s in some parts of Tennessee, Mississippi and Louisiana.

"We're making a lot of unfortunate history here in Mississippi in April and May," said Jeff Rent, a spokesman for the Mississippi Emergency Management Agency. "We had the historic tornados, and now this could be a historic event."

The Army Corps of Engineers was considering making similar use of other "floodways" - enormous basins surrounded by giant levees that can be opened to divert floodwaters.

A staccato series of explosions lit up the night sky Monday over the Mississippi with orange flashes and opened a massive hole in the Birds Point levee. A wall of water up to 15 feet high swiftly filled corn, soybean and wheat fields in southeast Missouri.


Upstream at Cairo, which sits precariously at the confluence of the swollen Mississippi and Ohio rivers, preliminary readings suggested the explosion worked.

But across the river, clearing skies gave a heartbreaking view of the inundation triggered by the demolition. The torrent swamped an estimated 200 square miles, washing away crop prospects for this year and damaging or destroying as many as 100 homes.

If they had a target for the area in Missouri that would be flooded, and the river isn't rising as fast as expected, that area could take longer to flood, hence the delay in allowing drainage back into the riverbed.

Lawsuit seeking damages for area farmers because of levee breach

Terry and Mary Beth Lee's farm stands -- or stood -- on the land that her great-great-grandfather settled more than 200 years ago. Her dad worked the fields beneath Birds Point levee up until he and his wife died within three months of each other in 1993, the year of the last 100-year flood.

"We vowed to them before they died that we were going to go to the farm and build a house there," Mary Beth Lee said.
Today, two centuries and a way of life are underwater after the U.S. Army Corps of Engineer's detonations late Monday and Tuesday breached the levee at Birds Point.

And what could prove to be a lengthy legal battle against the U.S. government is beginning.

On Tuesday morning, Cape Girardeau-based Cook, Barkett, Ponder and Wolz LC filed a lawsuit in a Washington, D.C., federal court seeking unspecified damages for the farmers and property owners in the spillway flooded out by the levee's breach. Later in the day, lawyers met with more than 80 residents of the floodway and surrounding areas and members of the media at the Clara Drinkwater Newnam Library in Charleston, Mo., to discuss the suit.

The civil action claims the property owners' Fifth Amendment rights prohibiting a government taking without just compensation have been violated by the corps' detonation of the levee system in Mississippi and New Madrid counties. The litigation, which includes 25 claimants, seeks class-action status. J. Michael Ponder, partner at the law firm, said the litigation counters the claims of the corps that the Army has the proper easements in the spillway to operate the project and flood about 130,000 acres.

Corps delays third breach after exhausting explosives supply

"SIKESTON, Mo. -- A third levee breach planned for Tuesday is being delayed by at least 24 hours because the U.S. Army Corps of Engineers used too much of the explosives on the first two detonations and do not have enough for the third breach yet, corps officials said at a news conference Tuesday evening.

Col. Vernie Reichling, who heads the corps' Memphis District, said they discovered the "potential issue" Monday night after executing the first breach at Birds Point in Mississippi County. The problem was exacerbated Tuesday after the second blast near New Madrid, Mo.

"We saw that we were potentially using more of the slurry mix than we had anticipated," Reichling said. "This comes as we are executing a plan that was hatched 30-some years ago and we are implementing it for the first time. So there has been a learning curve."

Monday night, they finally did it. The Army Corp of Engineers blew the levees at Birds Point in Southeast Missouri, flooding 200 square miles of Missouri’s best farmland. The farms - those silly patches of black dirt where we produce the food that keeps us alive - were sacrificed in order to save the tiny town of Cairo, Illinois.

The lawsuit claims that 5th Amendment rights are at stake, which offer legal protection for landowners before government can take private property. According to an article that appeared this afternoon on the PR Newswire, the cataract of water is flowing onto the farms at the rate of 550 feet per second, and (as one would imagine), it’s causing catastrophic consequences.

According to Monday’s Southeast Missourian, flood levels in Cairo reached historic highs on Monday night when the gauge hit 61 feet, shattering old records set 74 years ago. In February 1937, the rivers rose to 59.5 feet in Cairo, Illinois. Think about that for a moment. This flood of 2011 is breaking all known records.

The blown levees are good for Cairo; bad for the farmland in Missouri which experts say will be ruined for years. Midwestern farmland owes its fertility to those spring-time floods of yore, but this is not the way Mother Nature does things. When those levees were blown, that 15-foot wall of water brought with it sand and river-laden debris and all manner of pollutants found in flood waters. Experts predict it could take years for the farms to become productive again.

The Chicago Tribune reported that crops have already been planted on some of these farms that are now being inundated with this “man-made tsunami,” destroying the crops and causing hundreds of thousands of dollars of damage to the local farmers. In addition, as many as 100 homes could be destroyed by this plan.
