Breaking into or entering without permission of a habitation is a shoot on sight, no retreat necessary offense. If you have an intention of doing this, I recomend you find another state to do it it, because there are many here with the mindset that killing a criminal is a gift to society.

horseshit, there was an old guy just last week that shot up a couple of dopeheads stealing his tools in the middle of the day , no charges.One of them died and the other is critical. The man is up for a citation of valor, not criminal charges.

The law that enables it essentially is the killing is justified in the property owners mind when he feels the perp is a threat to life, limb or property. It doesn't have to be at night.

Hell, in this state you can shoot a cop dead if he attempts to arrest you and you are guiltless, the law allowing it is very specific!
