It is LAW that any debt that is "disputed" (USE THAT WORD) ...that "no third party' can intervene and that the debt collection returns to the original holder of such debt. (and they arn't going to do anything, that is why they sold it) I have used this many times and it works perfectly. The Texas attorney general told me to do this!! |

Every day, some scumbag from a company named Nelson and Kennard, calls and won't identify himself as being a debt collector(FDCPA violation#1). He also won't identify the debt they believe that I owe (violation #2). He instead fishes for personal information, to which I laugh at him and tell him he's insane or stupid if he thinks I am going to tell him anything over the phone. I say, "put your request in the mail". I told him that I wanted the contact info for his law firm's managing partner, his state bar ID, address, etc., so I could file a proper complaint. Surprise surprise, he dodged that request and would not tell me how to contact them formally. So, I looked up Nelson and Kennard on the internet and just finished filing a bunch of complaints with the FTC, the state's Consumer Affairs Dept and the state Attorney General. These guys are scummy, looks like they already have a bunch suits against them for bad debt collection practices. I am pretty sure that these douchebags bought some debt for a penny on the dollar and can't find the debtor. Now, they are phishing for the debtor by calling and fucking with everyone that shows up on a skip trace report. I used to help do PI work and for the hell of it, ran a skip trace on my name. It's about 50 pages long and I hate to think about how many of those people in the 50 pages of names & numbers are naive enough to fall for a debt collector's trix. Since the FCRA requires information providers (debt collectors) to accurately report information on a credit report, simply send them a "validation of debt" demand..this demand requires them to provide you with a certified copy of the original signed document. If they fail to "validate" it then they must remove all reference to it from your credit file or face $1000 a day fines. I've done it to many times and it works. Here's a generic form of the letter to send. Knowing the law and ALL of your rights granted within is a powerful weapon. I can assure you the idiot collector on the phone has never heard this before. When they call record the call or make the announcement before talking that the call is being recorded. There are thousands of attorneys that will collect that fine for you. RE: Account # CERTIFIED MAIL RETURN RECEIPT REQUESTED # Dear creditor, You are inaccurately and incompletely furnishing information regarding the above-referenced account to the CRA's in violation of the reporting requirements of the FCRA, Section 623, Responsibilities of Furnishers of Information, and for which you are responsible. I dispute your information in its entirety and request evidentiary documentation that substantiates the information you have furnished and its reporting. Should you not be able or willing to provide me with the substantiating documentation as verification to cure this violation, within the next xx days, please have the information deleted from each of the CRA's you initially furnished it to or, alternatively, do not respond to the next dispute that I initiate through the CRA's *******(or instead of the last sentence above: I will have no recourse but to consider legal action as a resolution) Nelson v Chase Manhattan, 2002 provides a cause of action for individuals against furnishers of information. Most collection agencies and telemarketers have call centers that use toll calls to save money. So I restrict all numbers coming from area codes 800, 855, 866, 877, and 888. Presto! Then they will have to call you specifically long distance like from area code 212-555-1212 so what you do is program the caller rejection to the area code and 555 prefix. Some companies buy blocks of continuous numbers within a prefix so block'm. Presto, no more calls. |

The very first thing I said in my OP was that I don't owe anybody any money and never have. Yet, I knew some dumbshyte in his mom's basement would still say "why don't ya pay em?". My last resort is to send them certified mail with a cease & desist. Especially since they won't disclose what they think I owe money for. I have a very common name (think John Smith or Antonio Hernandez), so I had an investigator friend pull a skip trace report for my name. A few minutes later, we were printing off a huge stack of papers with tons of people with the same first and last name, and people who are somehow connected to someone with that name. That's how these douchebags work. The names and phone numbers go into a robodialer and they start phishing. I guess that's why they try to be evasive when you ask them questions, they do't really know who they're dealing with. |

In the early years it was an honest business, but certain collectors started getting crafty and the "powers that be" started looking the other way. It's all about the money. If you truly owe the debt, negotiate for a much lower pay-off. If the collector is rude and pushy, refuse to deal with them and demand to speak with someone else. Beware! they will tell you they will transfer you to a "supervisor" but in actuality they just transfer you to one of their collection "partners." It's all a game to them and they "get off" wielding what they see as their brand of power! You can tell them to "cease and desist all calls" and by law they have to stop calling. If they continue to call, they need to be reported. Also be aware that they CANNOT call you until 30 DAYS AFTER you receive the DEMAND LETTER! |
