I have never really seen the utility in philosophies that promise us justice after we die but show no formula for covering our butts while alive! It takes more than faith to protect oneself. A prenuptial contract might help and then, making certain to establish residency just as far away from that 'baggage' as possible - preferably a different country entirely. I admit to certain prejudices: a man with failed relationships in his past is not a good prospect in any case. That shows poor judgment and weak character. You'd be surprised how many husbands don't like to even think of preparing for sudden death. Most people don't expect to die when they do and there are always loose ends. And 'deemed unfit' was my whole point. The husbands kids got to a judge. When there's a lot of money involved, most judges are corrupt. When I say 'valuable real estate' in the Phoenix area, I'm talking about millions.

Put the money in an irrevocable trust. Give cash out of the trust (either monthly or lump sum) to whomever you wish. If there are "contingent" beneficiaries, put in a clause about "anyone contesting the terms of the trust has their share reduced to 1 dollar per year." Be fair with your kids. Don't cut them out. Leave enough to your spouse to see to his/her support in view of other assets they may have. A widow inheriting a house that is paid for needs enough income to pay the taxes and upkeep on the house, plus enough for their own food, medical care, personal items, etc. Just the house is not enough unless they have other income of their own. Your 2nd wife probably wouldn't want the house you built with your first wife and raised your family in. It has no emotional value for her. While, by contrast, your kids who grew up in that home might want a chance to raise their own family there. Give them options. Remember to balance it out. Also remember that current RE values are 1/2 or 1/3rd of what they were a few short years ago. Get an appraisal if you're in doubt about the real market value of the property today, as it sits. Your five million dollar house may now only be worth a million or two. Could be more and it could be less. But find out for certain rather than assuming and acting in information that isn't accurate. If the eldest son gets the house, then the younger kids should get offsetting cash to make it fair and equal. However the exception is if one of your kids is making a ton of money and his brothers/sisters are not - he may not want a large inheritance. Where the other siblings might need it. Find out what they want and need by asking! Nothing like a candid conversation to find out peoples needs, wants, and expectations.

Also, at the end of life is no time to be holding grudges. It is time to forgive past wrongs and hope you get the same forgiveness, yourself. Heaven knows you've made mistakes too! And hurt others in the process even though you didn't mean to do so.

Remember you cannot control people from beyond the grave. It's fine to protect a child if they need it (say you've got a son or daughter who's got a drug problem.) You can arrange a trustee to look after their money and prevent their burning thru their inheritance as long as they have this problem. But if they can demonstrate a year or of sobriety, then they no longer need a guardian or trustee controlling their spending and if they choose to blow it at that point, so be it. It's their money then, not your money any longer.

If you have a son or daughter who's well off, then consider leaving their share of your estate to their children. Your grandchildren. This is usually done by agreement with their father/mother who would normally be inheriting from you but for one reason or another do not wish to do so.

Considering how many young people there are today ready to kill their elders off, I'm not so soft when it comes to 'kids.' All they want from their parents is what their parents worked for. You'll find it's a very small minority that actually spend any time and effort - let alone money - to take care of elderly relatives. Parents owe their children support till they're of legal age; they don't owe them a dime after that. No law compels a parent to give his property to his offspring or ex-spouses and their offspring. That only happens if he dies intestate.

To those who chose to "live in sin" be careful. In some states, if you live with your partner for 6 or 7 years it's considered a common law marriage, and your partner is then entitled as a spouse would be.

Lots of shit going on with old people these days.

They are being forced into guardianships by corrupt judges and having all their things stolen from them and left homeless.

Google it on the web. Keep a beady eye on them, the fucking predators are out in force.

That's true - and if you are elderly, keep an eye on your relatives too! There was a good illustration of this a decade ago in AZ. An elderly widow who had a lot of valuable real estate. The danger? She was a second wife. The children from her husband's first marriage terrorized her until she met them with a shotgun. Then the kids found a judge to declare her 'unstable' and committed her and the evil kids stole all the land!

Lesson: ladies, never marry guys who have kids from an earlier marriage. If he dies before you do, those kids will stop at nothing to take everything you both have. The government is bad enough but really, treachery is usually far closer to home.

Why do I say ladies instead of gentlemen? Because elderly women, of the 'old school' don't generally protect their own interests quite as well as the men do and are more inclined to trust their families. Big mistake!

I'm in my 40's and I have many friends recently that have lost a parent or elderly relative. Many!

The upcoming changes will be very difficult for them to weather. Pay attention to your aging relatives!hf

Is that still true? I know it used to be, but I know it's not true in my midwestern state anymore. I've been with the same woman for 22+ years now. We're not married, but that's mainly because both of us had past bad experiences with marriage (and both of her first husbands shared my first name too). We're married in every way except a piece of paper, but the law doesn't treat us that way, no common law stuff here. So we've had to make out wills and powers of attorney and so on. Not a big deal, but i kinda wish common law marriage still DID apply here. I think it should, at least after 20 years. Most ACTUAL marriages don't last anywhere near as long as we have.
