I wonder if the ruling would have been different if Obama weren't the worst leader of a nation in all of history?

I'm kind of stunned by the decision. Obama is a train wreck and practically Jimmy Carter's second term, but this decision came from the 9th circuit. It has a reputation for being the most liberal progressive politically biased federal appeals court in the land. If any court was going to smack down a threat against Obama this court would have been the one.

this was not a good ruling in my opinion

even if he was drunk that doesn't excuse his behavior

also the Judge he voted in favor of the ruling is an 80 year old demented man appointed by who else, jimmy carter

My guess is people are afraid to even use the words "president" and "assassinate" in the same sentence for fear of the secret service paying them a visit.

So much for the land of the free and the home of the brave.

If Congress cannot make a law regarding speech by what law does any Court assume jurisdiction to hear a case on speech?

Without a law there is no jurisdiction. They are usurpers of the law.

Right to the heart of the matter. Love it. I am so sick of people and even law makers in congress themselves defering to the courts when we have very clear 235 year old foundational law.

Makes me wonder if this ruling is nothing more than bait!

No the ruling does not mean you can threaten the president, that is still illegal, it means it is not illegal to say publicly or speculate that someone will do it

Bagdasarian statement was "predictive" and "ex hortatory" and was not an actual threat.

Threatening to kill anyone is serious is certainly illegal if the threat is against the president and credible. The word "exhortation" though means that the poster actually called for and encouraged murder. In today's world of Jihadists Imams calling for people to be killed and their followers screaming Allah akbar as they pull the trigger, this decision is stunning.

This is a dangerous game. A lot of people want Obama impeached and removed from office the right way and that's fine, but there is no place for actively encouraging an assasination. That is totally different and that is what the court said was not illegal. I can't believe this isn't bigger news.
