One of the things he said that really stuck with me through the years was this: "If you go out looking for problems, eventually you're going to find them. Even if you have to make them yourself." This seems to be the case here. The officer seems to be the type that forces problems into being. Was the driver perfect? It doesn't sound like it. For one thing, don't get aggressive in tone with an unstable armed man, even if you have a right too. But that doesn't excuse the use of violence against an unarmed non-violent person by the police, ever. Even if a person isn't "compliant" it's morally wrong for the police to use force against them if they do not offer violence. Always. The only time that goes away is when a person is a visible threat to themselves or others. Then an officer may have no choice. It frustrates the police if you don't do what they want, and is sometimes illegal, but that doesn't excuse harming another person. Their go-to move is force these days, instead of discussion. People need to protect themselves with politeness, but let's not forgive the police for their own wrong doing here. If we do, we encourage further such actions. "Get out of the car or I'll torture you with a taser." is probably enough reason to not comply. It's not a reasonable statement for a simple traffic stop. If the officer is violent sounding enough, well they are still an armed man in a situation where they can probably kill you and get away with it. Under the law, in most places, your own fear doesn't have to be reasonable to be considered as a plea of self defense. It's harder to prove with the police, but is still legal if the situation warrants it. Not getting out of the car, suspecting attack is a good enough reason. *You'll still have to prove it in court and in these days probably lose. Being polite really is the better way to go. Part of the problem is that the police have been changing the way the rules work slowly over a long time. People still try to comply with the actual rules, only to find that the "police procedure" is very different than the law now. The police don't enforce the law in the U.S. but their own policy, which can change from place to place. A lot of people getting caught up in things like this are actually legally correct, which is shown when all charges are dropped by the prosecutors. I think you'll find that I agreed with that at the end of my statement there. There is a difference though, between people protecting themselves by being polite and managing the police, and the officers having a legal and moral right to harm them for not doing so. There is not legal "attitude test". Oh, it exists, but it isn't a part of law. Your allowed to be rude, stupid and unfriendly to the police and they still have to follow the law... Right, however you will find that the street is not the place to debate the finer points of law with an armed person whose IQ is most likely 20 or more points below yours. Even if one is 100% in the right, do you want to spend a night in jail, pay for towing of your vehicle, take day(s) off work to appear in court and fork out thousands for a lawyer? Even if you win, you're still out a bunch of time and money. |

Not that I think that's right -- but when they take a situation and escalate it and make it even more dangerous and get themselves killed, why should we feel sorry for them? All the guy did was ask why the pig shined a light in his son's face, and the pig escalated it from there. This guy would have been within his rights to kill that cop (if things were as they should be). We shouldn't and we don't. |

THEY should wind up in jail for an extremely long time for violating their oath and for sheer animal violence. Their job is giving tickets for traffic violations and investigating crimes after the fact. It's your job to "out monster the monsters" if it comes to that, not theirs. Really, that isn't the issue here, but it's still true. The police shouldn't be expected to protect you from harm. How are they supposed to even get their in time? That's our responsibility. It's simply the physics of the situation. That part of life is now and always has been, down to you and me. Not that a police officer wouldn't try to help if you were being attacked, but it's not reasonable to expect them to be around for it.
