Police Officer Tases Seven-year-old Boy During Traffic Stop, Then Beats His Father
Another asshole thug cop, taking a minor situation and escalating it so he can tase and beat somebody. This is the same cop whose K9 bit a suspects penis off after he sicced it on him for no reason. Funny how this kid's father got charged with battery on a police officer -- it's the thug cop who should be charged!

Lawsuit accuses Gretna cop of Tasering 7-year-old boy during traffic stop

Published: Monday, August 22, 2011, 4:53 PM Updated: Monday, August 22, 2011, 4:55 PM
By Paul Purpura, The Times-Picayune

A Gretna police officer accused in a lawsuit this month of unleashing his canine on a suspect whose penis was nearly severed has been accused in another lawsuit of injuring a 7-year-old boy with his Taser

SNIP

The Bordelons were "traveling home" when Mekdessie conducted a traffic stop and allegedly shined his flashlight in the boy's face, leading the father to question why the officer was doing it, according to the lawsuit filed by attorney Edwin Shorty Jr. The officer then asked the elder Bordelon for his license and registration, and asked him to get out of the car.

The father twice asked why he was being ordered out of the car and refused to get out, "prompting Officer Mekdessie to say, 'Don't get tased in front of your son.'"

SNIP

When the father told his son to call his mother, Mekdessie fired his Taser, striking the man and his son. Mekdessie fired the Taser a second time at the man, causing him to fall out of the car and onto the ground, where the officer placed a stun gun to the man's neck and shocked him before putting him in handcuffs and dragging him and punched in the neck and face, according to the lawsuit.

Marlon Bordelon Jr. was taken to Children's Hospital, where a burn mark on his leg caused by the Taser was noted, according to the lawsuit. After he was released from jail on charges of battery on a police officer and traffic offenses, Bordelon Sr., was treated for a black eye and first-degree burns, according to the lawsuit.

here is the crux.

I really don't understand why people don't just co-operate in these situations. Yes, the officer's response was 100% excessive but seriously, would it have been that big a deal to get out of the fucking car?

Re: Police Officer Tases Seven-year-old Boy During Traffic Stop, Then Beats His Father
I heard a talk by an older man, a Vietnam veteran with no legs, who'd lost them in the war.

One of the things he said that really stuck with me through the years was this:

"If you go out looking for problems, eventually you're going to find them. Even if you have to make them yourself."

This seems to be the case here.

The officer seems to be the type that forces problems into being.

Was the driver perfect? It doesn't sound like it. For one thing, don't get aggressive in tone with an unstable armed man, even if you have a right too.

But that doesn't excuse the use of violence against an unarmed non-violent person by the police, ever. Even if a person isn't "compliant" it's morally wrong for the police to use force against them if they do not offer violence. Always.

The only time that goes away is when a person is a visible threat to themselves or others. Then an officer may have no choice.

It frustrates the police if you don't do what they want, and is sometimes illegal, but that doesn't excuse harming another person.

Their go-to move is force these days, instead of discussion.

People need to protect themselves with politeness, but let's not forgive the police for their own wrong doing here. If we do, we encourage further such actions.

And no sane or rational person should want that.

Sometimes it's best to shut your piehole and learn some manners when the cops are talking to you.

You want respect, you gotta give it first.

You wanna be treated like POS dirtbag, fine. Talk to the cop like he is one and he will return the favor.

In other cases it has been deemed reasonable for a person to not comply with the police if they suspect that the person is not actually an officer or means unlawful harm to them.

"Get out of the car or I'll torture you with a taser." is probably enough reason to not comply.

It's not a reasonable statement for a simple traffic stop. If the officer is violent sounding enough, well they are still an armed man in a situation where they can probably kill you and get away with it.

Under the law, in most places, your own fear doesn't have to be reasonable to be considered as a plea of self defense.

It's harder to prove with the police, but is still legal if the situation warrants it. Not getting out of the car, suspecting attack is a good enough reason.

*You'll still have to prove it in court and in these days probably lose. Being polite really is the better way to go.

The cop had no reason to request the guy get out of his car, he was just pissed because the father had asked why he shined his flashlight in his son's eyes. Just shows what a piece of shit that cop is, that he would pull his billy badass routine in front of a young child. At least that kid has learned at an early age that the police are nothing but thugs.

No, that came after the driver failed the "attitude test" by asking why he was being told to get out of the car. Still not right, but it's best to assume you're dealing with a prick and just play along. Usually everyone goes home without tasings, beatings or arrests.

I have been stopped by cops while out in a park drinking. I had a couple of beers in my coat, but no open container. Other people I was with got searched, but I was civil with the police and they didn't even try to look in my coat and then just sent me on my way.

Part of the problem is that the police have been changing the way the rules work slowly over a long time. People still try to comply with the actual rules, only to find that the "police procedure" is very different than the law now.

The police don't enforce the law in the U.S. but their own policy, which can change from place to place.

A lot of people getting caught up in things like this are actually legally correct, which is shown when all charges are dropped by the prosecutors.

The man may actually have legal standing to have acted as he did, meaning he was "following the rules" It didn't save him a beating though.

Indeed.

Did you ready my whole post? I think you'll find that I agreed with that at the end of my statement there.

There is a difference though, between people protecting themselves by being polite and managing the police, and the officers having a legal and moral right to harm them for not doing so.

There is not legal "attitude test". Oh, it exists, but it isn't a part of law.

Your allowed to be rude, stupid and unfriendly to the police and they still have to follow the law...

Which doesn't mean they will.

Right, however you will find that the street is not the place to debate the finer points of law with an armed person whose IQ is most likely 20 or more points below yours.

Personally, I would rather take a little shit and just smile and nod than get tased, beaten, arrested and charged with made-up offenses. Even if one is 100% in the right, do you want to spend a night in jail, pay for towing of your vehicle, take day(s) off work to appear in court and fork out thousands for a lawyer?

Even if you win, you're still out a bunch of time and money.

Every time now when I hear about a cop being blown away on the side of a road at night I wonder if maybe he wasn't acting like this one. Not that I think that's right -- but when they take a situation and escalate it and make it even more dangerous and get themselves killed, why should we feel sorry for them?

All the guy did was ask why the pig shined a light in his son's face, and the pig escalated it from there. This guy would have been within his rights to kill that cop (if things were as they should be).

THEY should wind up in jail for an extremely long time for violating their oath and for sheer animal violence. I'd agreed with that in general, but the civilian didn't seem to actually attack the officer, which makes the harm done wrong.

That the officer is already in trouble doesn't make him look good either, in a "where there's smoke" type of way.

I really doubt the man is long for the force there. Too many lawsuits will get even the officers union to cut loses eventually.

No one legally deserves a beating or torture for being "a dick".

We may feel like doing that sometimes, but we have laws to prevent violence, not sanction it by some without good reason.

People can't have it both ways. EITHER the police are quiet, respectable, safe public servants, OR they are strong enough, tough enough to outmonster the monsters.

If your cops are quiet, safe, and respectable, they will roll over and die in the line of duty as soon as they come up against someone with better instincts.

If your cops can outmonster the monsters, well, you just better not look or act like one of the monsters.

That isn't their job. Their job is giving tickets for traffic violations and investigating crimes after the fact.

It's your job to "out monster the monsters" if it comes to that, not theirs.

Really, that isn't the issue here, but it's still true. The police shouldn't be expected to protect you from harm. How are they supposed to even get their in time? That's our responsibility.

It's simply the physics of the situation.

That part of life is now and always has been, down to you and me.
