You get me legit information on how to do #1 / #2 and I'll go that route. I'm not risking my ability to buy another home on some hail mary play that most people do as a last ditch effort.

I already feel shafted that they resold the loan. I was ok with BOA taking it when countrywide went under - that made sense. However, selling my stable, good, loan that never had a late payment to a debt collection company is highly insulting. I'd prefer NOT getting calls on my cell phone about this - especially since the idiots have yet to send any type of official paperwork.

OP, the reason your payment due date changed is because your new bank does not have the original title. They are drooling at the mouth to foreclose on you.

People who owed very little to nothing on their mortgages have been foreclosed on. People who paid their homes off IN CASH, and therefore NEVER HAD a mortgage have been foreclosed on and forced to fight their bank in court.

Obama had the chance to fix some of this, and basically, he allowed the robo-signing and rape of the housing market to continue.

I suspect that as soon as they started harassing you about the late payment, they also quietly started foreclosure proceedings on your home. Chase did this to me for over a year, while they were pretending to be helping me with a refinance, and kept coming up with one excuse after another over why my refi wasn't being approved. I filled out refinancing paperwork 5 times, tried Obama's Hamp program, got turned down on a technicality, and was left with no option but to go with Chase's in-house program.

(I read where somebody filled out refinancing paperwork 15 times, and their bank told them it kept getting misplaced, or that they entered a wrong number somewhere and had to start over. Some banks are even claiming that they must not have gotten this paperwork because there was no INK in their FAX machine!)

Green Tree is not interested in helping you stay in your house. They are interested in keeping you paying your mortgage until the last possible moment, and then pulling the rug out from under your feet.

I suggest you save your mortgage payments, and demand that they produce the original title to the property. If they actually find it, you can simply negotiate to pay off the outstanding payments and catch up. If they cannot find the title, they may still try and foreclose on you, because no one has been effectively stopping these bandits so far. Then, you can 1. play their game like most people do, up until they give you 30 days to move out, 2. stop paying and get yourself a good lawyer, or 3. sell the house before they get their hands on it.

I tried step 1, until it became obvious that they were just stalling me, and not giving me credit for the payments I made. They said I owed like 8 months worth after National City mortgage sold the mortgage to Chase, even after I repeatedly showed them cancelled checks made out to and cashed by Chase. I couldn't afford to hire a lawyer, but I did stop making the payments. I tried to arrange a short sale, and this dragged on for some six months as Chase tried to haggle for a higher price with a prospective buyer. Finally, all was approved and ready to go on the seller's side and the buyer's side, except for Chase's final approval. The buyer had already been approved for their loan! Chase said 'hold on, we need a couple more days' after which they told me and my family to get the hell out of the house.

Chase's foreclosure department screwed over me and my broker, the buyer and her broker, the buyer's credit union, and even Chase's Loss Mitigation department!

Hell, if I would have known it would have turned out that way, I would have walked away from my mortgage as soon as Chase got a hold of it, and not looked back. It would have saved me a lot of cash, and a lot of grief.

What can you do if the bank, the courts, and the president are all working against you? Remember how they tried blaming the mortgage holders a few months ago, when it was CLEAR that the banks were selling fraudulent mortgages, and are still screwing people to this day?

I'm not really sure my situation resembles that situation - they arent trying to foreclose on me. I've never missed a payment, and I dont want to lose the house because I still have ~40-50% equity in it even with the down market.

We have been fighting Green tree for years when our Mortgage company sold out to them. They are awful...BUT
you can save money by making your payments at Wal-Mart...that's what we do. it's just a couple dollars.

At the Walmart money centers. They have a bill pay system that allows you to pay certain companies. Greentree LLC is on that list. I guess you have already seen how shady they are... it gets worse. If your Insurance is through them it will randomly get raised. Might want to get your own insurance with a contract.

my credit is already screwed .... with job losses and income reduction , afterwards i took a hard look at what we were spending in car payments bought a beater for $900 cash told the finance company to come get the suv that had been wrecked and they could not fix -i stopped paying that $900 mo car payment that included what we were paying for insurance,gas and maint. then my mortgage company went under as well and allegedly a p n c took over all their debts I asked them who actually owns the note of my house ...they can not tell me specifically ..just investors... i thought hhuuumm ok so I will pay but not specifically every month... now I pay quarterly ...get the letters (have unplugged my phone-no calls) about we want to help you keep your home blah blah blah ..we are gonna foreclose blah blah blah we are gonna ruin your credit blah blah blah I have been doing this for a year with them .... now that 2012 is approaching Im looking to step up my game with them

I opened an account with a local credit union today. I'm going to refi the house and cut my interest rate in half.

I'm sorry, but at 30, its not worth it for me to tank my credit and get stuck in a starter home for the next 7 years. Maybe some of you AC's can pull this, but I cant. I'm not strapped for $ and my back isnt against the wall with the debt. I can pay for the loan, and I intend to pay for the loan, to which I signed my name.

If the refi fails, I might consider other options, but its going to be hard to claim bankruptcy or anything else when I make 3x what my house is worth... I just don't have the $ on hand to pay off the note.

Send them an affidavit. Demand they produce the original wet ink note in court (which you could verify with forensics). If they sold your note chances are they've altered the contract (usually a stamp saying: paid in full, no recourse). Contract becomes void when they alter it. I've seen people win with this in court. Challenge the terms of the contract as well (e.g. interest..). Just in case they attempt to recreate the document once they can not produce the original. They can't recreate if you challenge the terms. I know people that do this on the regular. Don't live in fear brother.

I can do what? refi? I've already tried - 4 banks - denied 4 times. However, they were all the larger ones and had no desire to own such a small loan. Chase (my direct deposit bank), 5/3rd, BOA (who the loan was under), and Wells Fargo.

I figure I'll offer to move all my accounts to a local credit union and just say forget the big banks.

Have any of you who keeps saying to do the "produce the note" actually done this? It sounds great in theory - however, I know nobody who has personally done it. I do however know dozens of people who have gone bankrupt, lost homes, etc.

If you've personally done this - please post your case no. so all of us here at GLP can reference your case and your win.

I think the best suggestion is to keep paying and to ask for proof of ownership of the loan. I'm game for that - however exactly what is the legal process for doing that to get the document i need - and how does it have to be requested? I don't want to screw this up by not requesting the right thing or not sending the letter correctly.

Either way, I'm going to refi if I can. Like I said - I signed my name to the debt. I gave my word to pay it. I'll feel more accomplished in the end upholding my end, than trying to cheat the system - despite the fact that the banks are screwing us. I rather be the better person.

I am in the process of getting a PAS audit done and can't wait for the results! This will show everything about my loan and it's typically 150 plus pages so leaving it to a professional. They send me letters of foreclosure,acceleration yada yada but they have done nothing because I have sent RESPA letter and debt validation letters. Guess what! They haven't sent me shit for proof and legally can't collect! I have been paying for 10 years and just found this shit out so they get no more of my hard earned shit notes! WAKE UP!!!! they are going to be issuing me a nice refund as well by the time I'm done with them. You are just renting your property anyway so does not really matter in the end I guess. I'm moving to a paid for house and renting out my rental hahahahaha fuckers!dance

Either way, I'm going to refi if I can. Like I said - I signed my name to the debt. I gave my word to pay it. I'll feel more accomplished in the end upholding my end, than trying to cheat the system - despite the fact that the banks are screwing us. I rather be the better person.

Send them an affidavit. Demand they produce the original wet ink note in court (which you could verify with forensics). If they sold your note chances are they've altered the contract (usually a stamp saying: paid in full, no recourse). Contract becomes void when they alter it. I've seen people win with this in court. Challenge the terms of the contract as well (e.g. interest..). Just in case they attempt to recreate the document once they can not produce the original. They can't recreate if you challenge the terms. I know people that do this on the regular. Don't live in fear brother.

Have any of you who keeps saying to do the "produce the note" actually done this? It sounds great in theory - however, I know nobody who has personally done it. I do however know dozens of people who have gone bankrupt, lost homes, etc.

If you've personally done this - please post your case no. so all of us here at GLP can reference your case and your win.

I think the best suggestion is to keep paying and to ask for proof of ownership of the loan. I'm game for that - however exactly what is the legal process for doing that to get the document i need - and how does it have to be requested? I want the ACTUAL name of the request I need to submit. You guys want to see how this goes, I'm willing to do it, but seriously... get me the real procedure.

For the other AC - what is the RESPA request? I'm in foreign territory here. I'm willing to read up on stuff, but I need more info.

I plan on buying another house in 3 years and turning this current one in to a rental. That's why I still want my credit score solid. Were this my final home, we'd be having a different conversation.

I still cant really find any actual cases that are setting legal precedent. The banks wouldn't allow it... they'd settle first.

Just google RESPA request. You will find template letters you can download and send off to them certified mail with return receipt. When you see "this letter is from a debt collector" on the bottom they are third party. Then you google FDCPA guidelines and prepare to be a little excited because guess what! GT falls under these guidelines! EDUCATE yourself and you will be amazed how the wool has been pulled over your eyes. The banks are going down and we should do all we can to protect ourselves. You can also clean up your credit report pretty easy. It's all like a dream world to me now that I'm in the know.
