I love people who give terrible advice. You should never ignore a collection agency. First of all, if you used a credit card to purchase merchandise or services, the person who provided those services or goods was paid by the credit card company on your behalf. It is a rolling credit loan you can use continuously. You are obviously an asshole who sees no problem with stealing. If your argument is that evil banks steal all the time, you should be able to do the same. You have made a pathetic attempt at justifying your theft. You should own up to your responsibility. Second, when a you send a letter to cease and desist, the collection agency will cease bothering you, but then if they are any good at collecting they will immediately refer it to an attorney. If you ask for a validation of your debt, which you should if you don't think you owe it, then the agency should send you proof of the debt. Once the debt is validated if you keep disputing it and refuse to pay for the goods and services that were provided to you through credit, it should be referred to an attorney to sue you. I sue people all the time for debt that they refuse to pay on, and with a written contract I have 5 years to do it. If you think your debt has disappeared, it hasn't an attorney is reviewing it to see if it is collectible, and he/she has 5 years to do it. I love that argument in court . . . "well Judge it took them 4 years to sue me so they should just forgive my bad decisions". Once judgment is granted, interest, court costs, and execution on collecting the debt get tacked on. An original debt of $300 can be close to $1000.00 once an attorney gets involved. I especially love it when people send cease and desist letters to the collection agency then wonder why they received a petition and summons in the mail.

It's not about ignoring them. It's about playing their game. What I have seen that pisses me off is the outrageous delinquent charges that make it impossible for some people to pay off the original debt. THAT is what causes a lot of problems.

Also, I will say to never ignore a summons if you are unlucky enough to receive one because another thing that is being pulled is having people served with a Bench Warrant for a failure to appear when they don't show up for the hearing.
So.....if you are served at least MAKE AN APPEARANCE in court - or risk that bench warrant being put out for you.

huh? in a civil case where plaintiff is seeking relief for judgement? HOW BOUT DEFAULT JUDGEMENT.. no judge is going to issue a bench warrant for failing to pay a lender... how ridiculous.... UNLESS YOUR ARE REQUIRED TO APPEAR FOR DEPOSITION

If you own a home, these sea floor dwelling 3rd party collectors can and will place a lien on your property.

At that point you have the following options:

File bankruptcy
Never move or sell your house for the rest of your life
Settle the debts

It happened to me due to health issues (not able to pay bills). Scum.

I don't think it holds true anymore because the collection agencies bought your debt and that gives them some sort of lawful grounds
 Quoting: Anonymous Coward 2599618
They foolishly buy it at a discount. The letter creates so many loop holes they cannot respond in 30 days with the "DISCLOSURE REQUEST" they try and send you one thing which will be the fax from the original creditor but not all of the DISCLOSURES requested. They no longer have the right to collect for NOT providing all the information requested.
 Quoting: Sgt. Stedanko

They wrote me back and said they could not get the original copies of my signing but I owed $535 to them. This happened another time I was sent a court date here in my town for the debt I owed, I called them and told them I knew I owed the money just couldnt pay it at that time, they added over $100 to the debt for court cost and mailings they spent, also added interest on the debit.

I now have a clean credit record except Verizon I paid my monthly bill and stopped service, but now they want $300 for a 2 yr contract I didnt use. I would think there should be a way out of those phone contracts as no service was used from them. Do you know of a way out of the stupid contracts?

They act real tough but once you tell them you don't know who they are and have never done business with them... they become confused. Just tell them you never did business with them so you don't owe them jack shit. The phone calls will stop if you threaten to sue them for harassment.

They will settle for 30cents on the dollar and you can make them break that up into payments for a long time. Tell them to put it in writing and then just don't pay it.

rklawson1 said..."The simple fact is that these credit card companies have no legal standing to collect because they have never suffered a loss. They created the money out of thin air. The money never existed until you signed the credit application. So in reality you are the creditor not the debtor. The credit card companies collected membership fees and also received payments from you by leading you to believe that they loaned you money, which they did not. Also they collected interest payments on money they never had. The whole thing is a big fraud.
In order to sue one must prove a loss so that the court may make you whole again. These parasite credit card companies never lost a penny because they only benefited from the start by charging you for something they never had to begin with."hf

I know some people have used a tactic of renting from someone and having nothing in their names (power, etc), never changed their DL and Car Registration address, get a prepaid cell phone billed to a mail drop service, used a mail drop service such as:

[link to earthclassmail.com]

to receive their mail at an address in a totally different State from where they live and then use a service like

[link to rapidremailer.com]
or
[link to remail4u.com]
or
[link to remail-letters.com]

to send letters to the collection agencies to c&d ... and then they have letters sent to them from the person they are trying to collect from with a Florida or Kansas or Texas post office mark.

Then they just sit back and wait out the statute of limitations on the debt.

The collection agencies don't know what to do. No valid phone number, a mailing address for the person in say Nevada or Washington State but receive mail from the person they are trying to collect from postmarked from Florida or Kansas or Texas. Yet the person is happily living in say... oh... Virginia.

A number of people have told me about things like this and I read about more of them on various forums - I just am quoting the one that I thought was most creative. In the case of the person above they are like 2 months I think from their State of Limitations.

The banks deserve everything they get. Personally I am thankful I decided to live a life where I always paid for things in full within 30 days of buying them. I have a monthly overhead for my entire house of $500 a month plus food. Living on the cheap without stress. I would NEVER allow a bank to hold debt over my head.

They still are able to put it on your credit report, anyway to fight that?

What about being able to fight these phone companies for contracts? They say its because you got a nice phone from them. I ended up going to another company before my 2 yr contract was up and I had a cheap little flip phone.
I would think those 2 yr contracts are paying for services you never used.
