My parents' safe deposit box was ripped off by Chase Bank in Sacramento, CA
My parents had a safety deposit box with American Savings and Loan in Sacramento, which was purchased by Washington Mutual, which was purchased by Chase. They've had this box since 1980 or so and kept some gold and silver coins and some savings bonds that were gifts to them from older family members who have since passed on.

My parents had stopped receiving a bill for the safe deposit box and called the bank to inquire about that. They were told that they no longer had a safe deposit box with the bank because they had been into the bank and picked it up four years ago and that the manager had used his/her discretion to open it up for them without my parents' keys to the box. My parents are in their late 50s, so their memory isn't what it used to be, but they do not recall picking up the box. They no longer live in Sacramento so it would have been about a three hour trip to pick it up. Also, the bank cannot produce any proof they picked it up, and, most importantly, my parents still have the keys to the box.

I'm so upset for them. My parents are really good people who have worked so hard their whole lives and they don't have a lot of money. They weren't counting on this for retirement, but it would have really helped.

Their next steps are to escalate this within Chase to management above the branch level and see what they will do to help them. After that, if the bank isn't helpful, they're not sure what to do next

Anyone have any suggestions?

Do they have receipts on the savings bonds? If not they can contact the Treasury to locate the bonds and/or their status.

I'm 58 and would certainly remember if I'd emptied and closed out a safe deposit box! It's kind of a big deal, especially with some cool old family treasures in there.

Since they still have their key, something's amiss. There's no way a bank would let them keep it, with a properly closed account.

If U stop paying rent on the box they consider it abandoned and send the contents somewhere off site. I think fed gov ends up with the contents.

I get a free box because, well they love me...but I got a call saying that the previous owner opened my box and immediately closed it and said it wasn't his. I get there and tell them if there is anything illegal in that box that I was calling my attorney because they let someone open my box! Turns out the guy had stopped paying for it and they didn't change the lock...nothing was missing, or added...then they gave me a free Ipod docking station :)

Yep=== Chase also "lost" my child's $14,000 college savings account.

I didn't get statements for about a year after I opened the account...and luckily I went in to enquire, and it turned out that they had deposited the money into a 19 year old man's account.."by mistake..."

Well... I raised hell and they finally had to refund the money since I had kept the paperwork proving that I had opened the account.. If I had lost the initial paperwork though, I would have been screwed.

Banks require you to sign either a signature card or a log every single time that you go to the bank to get into the box. They also typically require you to provide ID, and I can't imagine a bank manager allowing access to a box without keys and without valid ID. 4 years ago the bank would have had a video system as well. If they didn't take it, someone else obviously did and it's theft, and possibly grand theft depending on the value of the contents. Your parents should request/demand copies of the signed log book/signature card, date and time as well. If the bank can't or won't provide it, go to the authorities & file a report. I'm 52 and can assure that I remember when I emptied my safe deposit box out years ago!

skidrowkitty And on a related note. Don't forget that in 1933 (I think) the Feds declared a bank holiday and seized all the gold in every safety deposit box in the country...and who knows what else.

And in the UK the police opened every box in a London depository without a individual court orders, about a year or so ago.

Sounds like a fairly simple identify theft scam. If the bank is saying the manager used his discretion to open the box up without the keys then they have a record of opening it so it wasn't seized by the gov or sent off site. I think someone found out they had one and faked the id's to get the manager to open it. As soon as a lawyer contact them I guarantee they will settle up, they can probably write it off as a burglary and get the insurance to pay

NAUPA is the national data base for unclaimed properties.

I have a hunch the contents are somewhere within the bank, you just haven't found the correct office.

Your parents should check the above website and if nothing seems to match, then find an attorney asap.

Next step is contacting the state's banking commission.

They are saying someone (bank says it was my parents) picked up the box saying they didn't have the keys (so the manager had to use his/her 'discretion' to open the box), but the bank can't produce a signature or any type of proof of who that actually was.

It takes TWO keys to open a safety deposit box, at least at Wells Fargo--The bank's key AND the customer key have to be turned in the locks. Cannot believe any other bank wouldn't operate the same way. No way the bank alone could use their key to open boxes.

If anyone ever lost their key, we had to arrange to have the box drilled open.

This post sounds like BS to me

Don't deal with the big banks. Local credit unions are your best bet. Chase is my number one enemy, second is Hells Cargo. I hate the banks. They suck the money right out of your accounts like they are vampires. Money vampires.

This is another reason not to trust banks for anything important. Once a bank has your money regardless of whether it is in an account or safety deposit box, the bank can and does place many obstacles in your path to ensure you cannot easy get to your money. Also, the government has passed several laws that basically give the bank a free hand in anything they want to do. Keep as little money as possible in a bank and nothing there that you cannot afford to lose.
