Let me Gingrich it for you: it's only the death penalty if you get caught, and if you get called guilty in a court of law for it. If you can find a way to do that without getting caught, you can go for it. If the case can't stand trial, you survive.

If nobody presses charges against you for pot, you won't get the penalty. In a crooked way, the person who points it out is pinned against the wall, because who is going to hold this accusation to the death of someone else?

If the truth comes out after the statute of limitations has expired, that is Gingrich's loophole.

The law is misplaced. It should be the death penalty for crack. That stuff is a country-breaker.
