I have watched there show and my impression was that they are a very unprofessional and dis organized group with some big wigs with money backing them. Some of the people had no experience being on a boat or that type of an environment and they put the lives of others on there mission in jeopardy. I thought they where a joke.

The way I read this Act is that they are not commiting piracy, but more trespassing on a privately owned boat. Which is its own crime. Pete Bethune was indicted in Japan on 5 charges, this included trespassing, not piracy after he tried to make a citizens arrest onboard the Shōnan Maru 2 in 2010. At this stage we do not know that the Australian men currently being held have threatened or used violence on the crew, held anyone in detention against their will or committed theft.

This is how I interpret it, and that as well would be the deision of any judge in a court of law to also decipher.
