Re: How to handle a DUI Checkpoint

You are an idiot and I hope they catch you drinking and driving before you hurt someone. THAT is why every few months helps keep people safe. A DUI lasts a lot longer.

There's a difference between freedom, and being part of a society. You don't live alone. Therefore there have to be rules, laws, limits. And there have to be people to enforce them. It's part of being a member of a group. You are a human living with other humans. In your home, do you do what you want in the name of freedom? Do you expect everyone in your home to cater to you and pull all the weight while you do what you want? They rules don't aply to you? Probably..or you live alone.

He has the right to drink and drive. You should bugger off and while your at it get a clue.

Re: How to handle a DUI Checkpoint
here's how you handle a DUI check point

sober

it's that easy

don't drink and drive shitheads.
innocent people die everyday from that shit.
 Quoting: LuciousGideon

It's not that easy! I had to go through a roadblock when stone cold sober. I told the cop I hadn't had anything to drink for over a week, and he didn't believe me(I hadn't).

Then they want to know where you came from, where you're going and why. They want to see your license, registration and insurance card, and they run them. They look inside the car for anything that might be illegal and ask questions about it - including an old radio I had from another car on the floor. This has NOTHING to do with DWI or DUI, and the radio was legally mine. It's just a fishing expedition for anything they can possibly find. They even ask if they can look in the trunk(not with my permission).

At one checkpoint that ran most of the night, they said that they stopped 10000 cars and found no DWI, but some drugs, missing insurance or registration, and a couple of wants and warrants. That's wrong.
 Quoting: Anonymous Coward 10924199

Why is that wrong? Drugs, warrants..this is their job. This is what they do. How would you have them do it? Coddle the bad guys and their illegal doings? Make sure it's okay with them how and in what way they find them?

They didn't arrest people for having cotton candy and puppy dogs. That would be wrong.

Wow's ass, he does have the right. You are not guilty or suspect of a crime unless someone's rights have been violated, or their property is missing or damaged.

Where does drinking and driving fall under that, you fucking prat?

The Sgt in that vid knew that this dude was driving around spoiling for an encounter...He rolled up with a cam on his dash...

She simply realized that this was a setup, and she didn't feel the need to be on YouTube more than the idiot had already taped her...

Every State has different laws regarding the Privilege of driving a motor vehicle...Driving is not a 'right'...

In many states you do not have the 'right' to refuse to answer lawful questions while driving...Refusal of lawful questions while driving can be used as tacit admittal that you are under the influence, and regardless of your 'rights', you can be convicted of DWI (or DUI depending on jurisdiction)...
 Quoting: SnakeAirlines

You're wrong, the constitution guarantees a right to travel, states can't say shit about it, and every officer, judge and politician takes an oath to protect the constitution...
 Quoting: Objective Perspective

The "Constitution" says nothing about cars, and 'Driving' has been upheld to be a 'privilege', not a 'right':

Here's your precedent, being wrong is no fun, I do apologize.

Nowhere in Thompson v. Smith, 154 SE 579 does it mention that a person can drive drunk, or without following the laws of licensing and registration...

What Thompson v. Smith, 154 SE 579 states is that no "City" can regulate the highways as that is a State 'right'...

Don't worry, Greenland, there's plenty of real men here who are not willing to live in a fascist country. It will turn around, but it will take time.

During the rise of Hitler, was there a large segment of society who loudly excoriated uniformed thugs or their shills?

I would offer there was not.

If you take a look at the posters, those for and against these fascistic checkpoints, you will see a majority are against and many are becoming violently opposed.

Coming to America now as a tourist may not be a great idea if you treasure your privacy. Give us a decade or so to clean shop. America will be free again.

Maybe I can spell it out for you, it may be against the law in all 50 states to drive over the legal limit, but it is against common law, which dates back to 1215, to violate aforementioned;

If a personal right or property was unaffected, there is no crime. I'm not even saying I agree that there shouldn't be stiff penalties against those who cause accidents and hurt people, but checkpoints are a violation of natural rights. You can't argue that. So what are we still talking about?

I am certainly not "for" any 'checkpoint' of any kind...

I do however realize that the courts have upheld them to be 'lawful' (since 1990) as long as they are checking for inebriated drivers, and not 'checking papers', etc...

Where I live, the cops have to publish the checkpoint location 48 hours in advance...

So don't drive through one...

'Problem' solved...

You don't get it.

Perhaps if the Nazis published the train schedules to Dachau the Holocaust would have been OK with you?

The 4th Amendment is crystal clear, regardless what some waste of a human being in a black robe says about it.

Courts have also stated that slavery was OK and it's all right to kill your child up to childbirth.

It's people like you that worship at the feet of those in authority (courts, cops, judges, congress) that have utterly F'd this country. You were given the gift of reason - USE IT! Or are you an adult child, looking up to your surrogate parent, the government?

As long as you don't smell of liquor this should work as you cannot be compelled to testify against yourself and they can't arrest you for refusing to answer.
 Quoting: Anonymous Coward 8625642

Uh, no. This is not why this worked out. The reason this worked out is that he didn't incriminate himself and he didn't verbally contract and he didn't make them sure he was a corporate citizen.

In essence everyone has common law (constitutional) rights. But, when you start opening your mouth you end up verbally contracting. This guy was smart. He didn't.

Another, much faster way to force them to realize that you are not going to be handled as a "person" but instead will be handled as a "natural person" is to do it like this:

Officer: Sir, have you had anything to drink this evening?

Driver: Name and number please, sir.

Officer: Robert Smith, P54321

Driver: Sir, Under common law I do not consent and I waive the benefits. Am I free to go?

Officer: Have a nice day, sir. You're free to go.

In the video it required a supervisor to make the common law determination. They know they can't do anything to "natural persons", its only after you contract with the corporate goon squad that they start demanding that you do what they say.

Get a clue people. Study the law. The fact is, you can drink and drive. It is not a crime. Anyone who says it is just doesn't understand law. Driving while having a few, even dangerously is not a crime. It cannot be. No victim, no crime. You are all such sheople. I'm not suggesting it, I'm just saying that unless you hurt, kill or damage someones property, you're good. Yeah, Yeah, I can hear you all whining. Go ahead, bitch all you want. No victim, no crime. Get a clue and keep your rights.

...LIKE THIS GUY!
