That's already illegal in some apartment/condo complexes in CA but it varies depending on the landlord.

If in fact the neighbors smoke is reaching the woman's property, and if in fact she can smell it in or around her home, then the neighbors are in fact infringing on her rights not to smell their smoke on her property.

I'd say she has a valid case.

If she can smell it in her home she needs to have an inspector come tell her where the air leaks in her house are. If this is what the world is coming to I'd love to turn my neighbor in and ban parking sh!tty cars in the driveway. It's infringing on my rights to not see eyesores while on my own property getting the mail.

I'm a former smoker myself, but I never bought the second hand smoke is bad for you crap. I knew the day they imposed separate smoking sections in restaurants that the agenda would not stop there. At the time, smokers didn't have a problem with it because they understood that not everyone enjoyed the smell of smoke. Little did they know they just fell in a trap and would be hounded to the gates of hell. They have now moved to your vehicles, the open air spaces and even the home you pay rent for monthly. I'm not at all surprised to see them overtaking private property. If you want to see the insanity the governments or courts will impose, look to the fruitcakes in California. They seem to start everything.

People need to look far down the road before favoring a certain action or law because it just seems right or justified because the old saying, "give an inch and they take a mile" will apply every time.

Now I didn't say this wasn't ridiculous. I just stated a fact.

Here's a little story. A good friend of mine lived in a condo with a smoke stack for a neighbor. The smell actually came up from her condo (bottom floor) into his condo (second floor) and stunk his place up big time. To the point he had to have it professionally cleaned to rid it of the odor and make the property ready for sale.

Now smart guy, he had to pay someone out of his pocket to rid his home of someone else's foul odors. He didn't take the smoke stack lady to court over it but in my opinion he should have.

Fuck it, let's outlaw curry while we're at it. That smell lingers in rentals as well.

I hope that lady wears perfume. I'd countersue with that just because I can, or that obnoxious odors are wafting over from her house, just because I can. It can get very ridiculous if the courts don't nip this crap in the bud. No one knows how to be a good neighbor or tolerant anymore. That guy is likely outside smoking so that he doesn't smoke in front of the kids or wife and now he is being persecuted by his nasty neighbor for doing the right thing!

I'd say the landlord could probably claim damages if someone stunk up a unit. They don't normally do that but the probably could if they could prove their case.

The way I see it, if I'm out in public and I smell your cigarette, there's nothing I can do about that. If I smell it in my home, we've got problems.

I believe there are zoning laws for that. And I currantly do live next to a manure farm, so there. I have neighbors that fertilize the fields with poop twice a year and I don't complain about them. It makes for a pretty ripe two weeks out of the year. I don't complain about it. They were here first, not me. The problem these days is no one is willing to suffer a little to keep the peace. By your logic, the smoker could sue the lady for denying his right to have a smoke in the privacy of his own home or property. It works both ways. So as long as its not 24 hours a day, 365 days a year, grin and bear it and realize it really isn't the end of the world.
