The Secretary shall establish a national medical device registry (in this subsection referred to as the ‘registry’) to facilitate analysis of postmarket safety and outcomes data on each device that— ‘‘is or has been used in or on a patient; ‘‘and is— ‘‘a class III device; or ‘‘a class II device that is implantable, life-supporting, or life-sustaining.”

A class II implantable device is an "implantable radio frequency transponder system for patient identification and health information." The purpose of a class II device is to collect data in medical patients such as "claims data, patient survey data, standardized analytic files that allow for the pooling and analysis of data from disparate data environments, electronic health records, and any other data deemed appropriate by the Secretary."



“The Secretary to protect the public health; shall establish procedures to permit linkage of information submitted pursuant to subparagraph (A, remember subparagraph A is the class 2 implantable device reference) with patient safety and outcomes data obtained under paragraph (3, which is electronic medical records); and to permit analyses of linked data;”

Continuing on to page 1007, in the STANDARDS, IMPLEMENTATION CRITERIA, AND CERTIFICATION CRITERIA section, the secretary of health and human services is given full power to intact all mandates from the laundry list of to-do items in the creation process of the registry as well as dictate how the devises listed in the National Medical Device Registry are to be used and implemented.

"The Secretary of the Health Human Services, acting through the head of the Office of the National Coordinator for Health Information Technology, shall adopt standards, implementation specifications, and certification criteria for the electronic exchange and use in certified electronic health records of a unique device identifier for each device described in paragraph 1 (National Medical Device Registry), if such an identifier is required by section 519(f) of the Federal Food, Drug, and Cosmetic Act (21 U.S.C. 360i(f)) for the device."

Now on Page 503, section E Lines 13-17 and I quote: "encourage, as appropriate, the development and use of clinical registries and the development of clinical effectiveness research data networks from electronic health records, post marketing drug and medical device surveillance efforts". Let me say that again, medical device surveillance efforts!

Now lets look at section 163 of HR3200, which gives the government a direct electronic access to your bank account which will work in conjunction with an implanted chip.

Page 58 Lines 5 through 15 reads:
(D) enable the real-time (or near real time) determination of an individual’s financial responsibility at the point of service and, to the extent possible, prior to service, including whether the individual is eligible for a specific service with a specific physician at a specific facility, which may include utilization of a machine-readable health plan beneficiary identity detection card; (E) enable, where feasible, near real-time adjudication of claims

I can tell you that at least from what I understand the registry is to track medical device safety. It pertains to all kinds of medical devices in place today and has nothing to do with RF ID's being implanted.

The purpose is to have a safety tracking mechanism, per device. Right now there is nothing like this.

I watch closely just for this kind of thing however.

People who think this bill means RFID chip implants will be mandatory are EXTREMELY DUMB, and they deserve to be mocked.

The bill states that IF you have a medical device implanted in your body, there will now be a registry to track the fact that you have that device in your body.

The bill then goes on to state that RFID chips fall within this classification of medical implants.

If you want me to illustrate just how dumb you really are, and just what an astounding, horrific failure of logic you've displayed, here's an analogy;

It's like if they revealed in a bill that starting in 2013 there will be a national registry of Compact Cars. And that the Ford Focus falls within the category of 'Compact Cars'.

And from this, you've discerned that in 2013 it will be mandatory to own a Ford Focus.

It is in the bill....
If you do CTRL+ F and type implantable it will take you to the section of the bill that tells you about the implantable device. It is not listed as RFID but as an implantable device for the National Medical Device Registry.

‘(B) validating methods for analyzing patient safety and outcomes data from multiple sources and for linking such data with the information included in the registry as described in subparagraph (A), including, to the extent feasible, use of--

‘(i) data provided to the Secretary under other provisions of this chapter; and

‘(ii) information from public and private sources identified under paragraph (3);

‘(C) integrating the activities described in this subsection with--

‘(i) activities under paragraph (3) of section 505(k) (relating to active postmarket risk identification);

‘(ii) activities under paragraph (4) of section 505(k) (relating to advanced analysis of drug safety data); and

‘(iii) other postmarket device surveillance activities of the Secretary authorized by this chapter; and

‘(D) providing public access to the data and analysis collected or developed through the registry in a manner and form that protects patient privacy and proprietary information and is comprehensive, useful, and not misleading to patients, physicians, and scientists.

Read the report, No. 2006-02, titled "The Use of RFID for Human Identity Verification" and the FACT is they plan on using some type of RFID technology in connection with all sorts of electronic communications systems to verify individuals for electronic commerce. What type of technology will be used is, as of yet, not being devulged.

WTF are you talking about? Pepsis? What does anything you just said have to do with what I just said?

There is no place within that law that states that RFID implants will be mandatory. It simply states that anyone who *does* have an RFID implant, will be included in the registry.

Two points:

1) It's ridiculous that they don't already have such a registry. I would have thought it would be common sense that where an implant has gone and it's statistical effectiveness would have been kept track of from the get go.

2) If mandatory RFID chips ever did happen, did anyone think there *wouldn't* be a registry to keep track of them? It doesn't make much sense to chip a population if you don't actually track them.


So in summary, nowhere in this law does it say anyone is getting mandatory RFID chips, and we already know if they ever did have the balls to try to chip us, there would be a registry keeping track of it, so this is an absolute NON STORY. There is nothing of remote interest in that law, or in this thread.
