The word “firearm” became “destructive device” at that time. This tax code was enacted in response to the St. Valentine’s Day massacre and specifically designed as a way to arrest gangsters for possessing unregistered firearms. The IRS was a key player in stopping gangs at the time and was even used to bring down capon just 3 years before this was enacted. I'm only human, it's my biggest flaw. We must all realize a sink a chair and a pillow are all luxuries of home and a soldiers helmet takes the place of all three. |

But you have to pay the $200 dollar transfer fee plus any state tax fees. The state fees vary from state to state but you have to pay the state tax EVERY single year if your state does have a fee... This is a old school Tax stamp Q: What are the required transfer procedures for an individual who is not qualified as a manufacturer, importer, or dealer of NFA firearms? ATF Form 4 (5320.4) must be completed, in duplicate. The transferor first completes the face of the form. The transferee completes the transferee’s certification on the reverse of the form and must have the “Law Enforcement Certification” completed by the chief law enforcement officer. The transferee is to place, on each copy of the form, a 2-inch by 2-inch photograph of the transferee taken within the past year (proofs, group photographs or photocopies are unacceptable). The transferee’s address must be a street address, not a post office box. If there is no street address, specific directions to the residence must be included. If State or local law requires a permit or license to purchase, possess, or receive NFA firearms, a copy of the transferee’s permit or license must accompany the application. A check or money order for $200 ($5 for transfer of “any other weapon”) shall be made payable to ATF by the transferor. All signatures on both copies must be in ink. Fingerprints also must be submitted on FBI Form FD-258, in duplicate. Fingerprints must be taken by a person qualified to do so, and must be clear and classifiable. If wear or damage to the fingertips do not allow clear prints, and if the prints are taken by a law enforcement official, a statement on his or her official letterhead giving the reason why good prints are unobtainable should accompany the fingerprints. Forward the completed application and appropriate tax payment to the Bureau of ATF, National Firearms Act Branch, P.O. Box 530298, Atlanta, GA 30353-0298. Transfer of the NFA firearm may be made only upon approval of the ATF Form 4 by the NFA Branch. If the application is approved, the original of the form with the cancelled stamp affixed showing approval will be returned to the applicant. If the tax application is denied, the tax will be refunded. Upon approval of the ATF Form 4, the transferor should transfer the firearm as soon as possible, since the firearm is now registered to the transferee [link to www.atf.gov] I'm only human, it's my biggest flaw. Look at how the Fifth Amendment was used in this case and what it still means today to you! As structured in 1934, the NFA imposed a duty on persons transferring NFA firearms, as well as mere possessors of unregistered firearms, to register them with the Secretary of the Treasury. If the possessor of an unregistered firearm applied to register the firearm as required by the NFA, the Treasury Department could supply information to State authorities about the registrant’s possession of the firearm. State authorities could then use the information to prosecute the person whose possession violated State laws. For these reasons, the Supreme Court in 1968 held in the Haynes case that a person prosecuted for possessing an unregistered NFA firearm had a valid defense to the prosecution — the registration requirement imposed on the possessor of an unregistered firearm violated the possessor’s privilege from self-incrimination under the Fifth Amendment of the U.S. Constitution. The Haynes decision made the 1934 Act virtually unenforceable 50% rule. [link to www.atf.gov] So it is now referenced as the 1968 act and enforceable again. Tom Fleming, Henry Bowman's friend says in effect that as honest adults we think we have the right to own small arms and shoot them. He compares the importance of our gun culture to the Native Americans living as nomads and hunting buffalo. He stresses the importance and states that with almost non existent criminal involvement, incomes and educations above average, and willing to pay for it, you'd think Washington would be happy but they try to destroy a culture. Then he says: "In the 1920s, soldiers sat on their bunks in the cold at Camp Perry, cleaning the handmade .22 target rifles with which they would compete the following day. Quoting: Chrit The Secretary of course is Timothy Geithner The national fire arms act of 1934 was created to impose a severe tax to discourage the purchasing and transfer of firearms from one person to another. They later removed the term firearm and replaced it with the term destructive device. The tax has been unchanged in the 78 years since it was enacted and is still $200 dollars if you wish to purchases a destructive device, this “transfer fee” is collected & your destructive device is registered to you. The sectary of the treasury responsibility is to determine what is considered a weapon and what is considered a “sporting purpose” shotgun. No law has to be passed to change what shotguns are legal and what shotguns are considered “destructive devices” unrelated to sporting, it is at the whim of the sectary. Here it is Title 26 > subtitle E > chapter 53 > subchapter B > Part 1 > section 5845 of the tax code.
