Ebay sellers forming class action lawsuit against Ebay
Ebay's server system has been failing to deliver what it promises its sellers, which is full visibility to all buyers and regions of buyers.
Recently and perhaps for some time, Ebay's servers that control the auctions, sales, item search, and visibility of items for sale has been compromised profoundly, either deliberately or because of a malfunctioning server system. Ebay has failed to alert the public, or their customers, the sellers.
A third party has created multiple selling accounts on ebay and has monitored its items visibility online in different regions of the U.S, and found major failures in Ebay's servers. Items are simply not visible to customers, sometimes never at all.
Many Ebay sellers are aware and have been complaining in Ebay's forums and other forums online. The class action lawsuit is commencing and soon sellers on Ebay will be notified.

announced today that it has filed a class action lawsuit against online
auction site eBay. The suit was filed on behalf of eBay customers whose
auctions did not start when their listing was submitted, and paid for but
did not receive the full duration of auction time that they selected.
"eBay has been deceiving millions of consumers over the years by
claiming their auctions start when submitted, when in reality they do not
begin for at least several hours, and up to 24 hours," said John Fabry, the
Williams Kherkher attorney who is leading the litigation. "However, the
clock starts running on your selected auction time even though eBay hasn't
posted it yet."
The suit focuses on violations of various provisions of California
statutes intended to protect consumers, as well as common law. The suit

Who knows of a class action suit on eBay for to eBay charging commission fees for shipping fees? If there is one, i'd like to get in on it. If not --- how do we start one. I make no money when I buy a USPS standard box to ship --- then eBay charges me a commission for this fee. I end up losing money to eBay. I am not alone.

I agree about the commission on Postage but postage charges can be grossed up to cover the commission by dividing the actual postage by [1-(percentage of Ebay commission paid on postage)]. I wish there was some way to fight the loss of my Top Seller status because, sometimes, the product I sell can be shipped in a First Class envelope with postage stamps. Thus, I have no tracking numbers to upload because it would rip off the customer to charge them $1 more for postage to get tracking on a business sized envelope. Further, about 99% of my business is customer work, which cannot be prepared and shipped within the new 1 day handling requirement when orders are heaviest. Now I will lose my 20% seller discount because I have lost my Top Seller status. So, in months when orders are heaviest, I pay Ebay the maximum commission percentage, which defies all business models except theirs! I am a retired CPA and well experienced in telling other people how to increase their profits. Apparently, Ebay has some pretty shrewd accountants also because the way they have structured this requirement virtually eliminates the 20% discount for many of their customers, which puts a ton more money in Ebay's pocket. This is mercenary and unjust when the ratings from my buyers in every category of service besides tracking uploads is well above standard, sometimes buy 1000%. This is the lawsuit I am waiting to join! I think raising your fees all the while denying that they are raising fees is fraud.

Hi! This is from the new user agreement...if you don't send ebay a wriiten letter opting out, you are agreeing to waive your right to join a class action suit against ebay.



Just wanted to pass it on.



Updated provisions governing how disputes between eBay and eBay users are resolved.

The User Agreement contains an Agreement to Arbitrate, which will, with limited exception, require you and eBay to submit claims to binding and final arbitration, unless you opt-out of the Agreement to Arbitrate by November 9, 2012. Unless you opt-out: (1) you will only be permitted to pursue claims against eBay on an individual basis, not as part of any class or representative action or proceeding and (2) you will only be permitted to seek relief (including monetary, injunctive, and declaratory relief) on an individual basis.

Opt-Out Procedure

You can choose to reject this Agreement to Arbitrate ("opt-out") by mailing us a written opt-out notice ("Opt-Out Notice"). For new eBay users, the Opt-Out Notice must be postmarked no later than 30 days after the date you accept the User Agreement for the first time. If you are already a current eBay user and previously accepted the User Agreement prior to the introduction of this Agreement to Arbitrate, the Opt-Out Notice must be postmarked no later than November 9, 2012 . You must mail the Opt-Out Notice to eBay Inc., c/o National Registered Agents, Inc., 2778 W. Shady Bend Lane, Lehi, UT 84043.

The Opt-Out Notice must state that you do not agree to this Agreement to Arbitrate and must include your name, address, and the user ID(s) and email address(es) associated with the eBay account(s) to which the opt-out applies. You must sign the Opt-Out Notice for it to be effective. This procedure is the only way you can opt-out of the Agreement to Arbitrate. If you opt-out of the Agreement to Arbitrate, all other parts of the User Agreement and its Legal Disputes Section will continue to apply to you. Opting out of this Agreement to Arbitrate has no effect on any previous, other, or future arbitration agreements that you may have with us."

I lost a lot of money on ebay; and this is exactly what I suspected was the reason. I had great items (one of a kind, very rare, finely crafted, antiques and collectibles, most in near-mint condition). Most of them got very few views, and would sell for the starting bid (with free postage, too). One very popular item however, got more than a thousand views -- but only ONE bid (the starting bid, free postage). It was so disappointing and I lost my ass so much, I had to give it up.

In my case, I believe it was absolutely done deliberately. Most of my buyers (at least 99.9% of them) were perfectly happy doing business with me (they should have been, they were getting extremely good deals from me); but there's always the few who don't ask for a refund nor do they return the item, yet they complain, criticize or downrate anyway, over something really stupid and petty (these are usually competing sellers, who will do that)

Nevertheless, if ebay doesn't like a seller for any reason, instead of doing such underhanded business, they ought to just ban the seller outright. If they have no legal grounds to ban someone, they should treat us all the same (we all pay the same rates for services, after all).

Also, once when I became very angry with ebay about there customer rating system (as were LOTS of other sellers at the time), and expressed my dissatisfaction on their forum -- they sic-ed DHS on me as if I was some sort of threat to them.

I hate ebay, and will never do business with them again. I also suspect similar problems with a few other online seller hosts.

Another thing about ebay that sucks, is the way they try to control your business proceedures (like your starting bids, postage and handling fees...) as if it's THEIR business, not yours. Then, when you go along with their policies (after quite a lot of 'persuasion' from them), you wind up losing your ass. I believe that's totally deliberate, and that they are aiding certain buyers in acquiring valuables for literally nothing. They're stealing from sellers, in other words. The ones who repeatedly got me, were all from very large cities or metropolitan areas (LA, Chicago, NY, etc.).

No you are not alone. I have been bothered by their charging me fee's on shipping when they have nothing to do with shipping my items. I ship through the USPS and I don't make anything on shipping. How is it that they can charge me fees for a service they don't even provide. And if you do go through e-Bay for shipping you pay for that one on top of the 10% final value fee's. not to mention the fee's for all of the extra's like( Picture Pak. E-Bay got big for it's own britches. they have become Corporate BULLIES with a CAPITAL B:I am not sure I will join this class action suit, Because I am On a QUEST to get the original Positive feedback system as it was designed to be and worked perfectly fine until Ebay added the Performance rating section on to it. All that did was cause MANY, MANY sellers to get 97% feedback ratings although there's and my performance standards dropped if the buyers did not give you 5 stars. Then I was put on selling limits for three months, till one day I received a message that even though my ratings have been improving I was still below the performance standard in the item as described section, and they were permanently restricting my account. NOW I can't sell anything. I have been selling for 3 years, and I am on disability so this has filled in my income a little. And I have always done the best job I can possibly do for the buyers. I never complained if they wanted a refund, which only happened a couple of times.. so thats where I am at. I know this is a long message. ok book.. lol

Out of the complaints listed here. This is the most legitimate. Although the paypal one is a good one like it says above, eBay intentionally dilutes searches.
In other words, a small seller gets shut out of ADVANCED SEARCH on ebay ironically if you dig through the category search it may show up there. It is impossible to do an exact search. For instance, if you want to search just one sellers items, you cannot do a search. You have to parse through the seller profile link, and click to see "only searches from this seller". It's a diversion tactic and it's useless to even you customize searches. You sellers need to discover eBay through the buyers perspective, you the seller are letting eBay 'hide item searches'. Seriously, I don't spend time on eBay anymore as a result of eBay not honoring my 'exact search' (Exact word search?)

Look in eBay's completed item search? Now why on earth would they list current items in green? When I say completed items I mean that. The completed item search is good litmus test to see if your items are showing up.

eBay needs to terminate those responsible for their 'search engine'(s). It's a broken system beyond repair.

Paypal and ebay need to be accountable for the limitations and shutdowns of so many individuals and businesses buy and selling on ebay.
There has to be a law put in place to prevent the invasion of business and personal privacy, no seller should have the need to divulge there business suppliers , personal information eg to a advertising service company or to a payment processing company.

They are constantly sending small business into hardship with there limitations , suspension and in a lot of cases permenant closer of accounts for no reason.

In Australia we can register a business name , abn , business banking account , domain names , etc and give no where near the rediculas information requested by both ebay and paypal. I am yet to experience or hear of the Australia banks or even asics require your proof of shipping POD's , and close your business if not supplied and I am yet to see them ask you to provide your supplier details which I believe is against business privacy.

WE NEED TO TAKE ACTION AND NOW ,EBAY AND PAYPAL WANT TO TRADE IN THIS CONUTRY THEY THEY NEED TO RESPECT AUSTRALIAN OWNED BUSINESSES AND STOP CLOSING ACCOUNTS CAUSING CLOSER AND HARDSHIP FOR AUSTRALIAN BUSINESSES DAILY OR GET OUT OF OUR COUNTRY AND BE CUT FOR GOOD.

IMAGINE IF THERE WAS A EBAY AND PAYPAL STRIKE IN AUSTRALIA

99.5% positive
My item as described is 1.04% there max is 1.0% communication is 0.53% max is 2%
shipping time is 0.24% max is 2%
shipping charges 0.34% there max is 2%
feedback of 14542

They just single handedly shut down my main income source.
BTW the next day my item as described DSR went to .95.
