Television networks are having a busy month trying to stamp out new TV-watching technology, including telling a court that skipping a commercial while watching a recorded show is illegal. Yesterday, Fox, NBC, and CBS all sued Dish Network over its digital video recorder with automatic commercial-skipping. The same networks, plus ABC, Univision, and PBS, are gearing up for a May 30 hearing in their cases against Aereo, a New York startup bringing local broadcast TV to the Internet.

EFF and Public Knowledge filed an amicus brief supporting Aereo this week.

The suits against Dish are a response to the "Hopper" DVR and its "Auto Hop" feature, which automatically skips over commercials. According to the networks' complaints, the Hopper automatically records eight days' worth of prime time programming on the four major networks that subscribers can play back on request. Beginning a few hours after the broadcast, viewers can choose to watch a program sans ads.

Broadcasters Warn of Apocalypse in Dish’s Ad-Skipping Service

Broadcasters are claiming in federal lawsuits Thursday that Dish Network’s DVR service, which allows the automatic skipping of commercials, breaches copyright law and retransmission agreements.

The suits by Fox, CBS and NBC are the broadcasters’ latest legal salvos against technological innovations, as those advances bring into question whether broadcasters’ longstanding business model can survive the digital age.

The Dish Network litigation concerns the March introduction of what the satellite company calls PrimeTime Anytime, which allows customers to record and store about a week’s worth of prime-time broadcast television. And two weeks ago, the Colorado company enabled playback of those archives without users seeing commercials.

The networks are labeling it a “bootleg” service that produces unauthorized copies of their shows and say it breaches signed licensing deals. And the consequences are dire, they warn. If the courts don’t block the service, it “will ultimately destroy the advertising-supported ecosystem that provides consumers with the choice to enjoy free over-the-air, varied, high-quality primetime broadcast programming,” the broadcasters told the court.

In the early 1980s, the Supreme Court ruled Americans have the fair use right to time-shift lawfully obtained content for later viewing. But that was using primitive technology like the VCR and Betamax, with limited recording capabilities. The Dish service records a day’s prime time lineup from ABC, CBS, NBC and Fox and stores up to 100 hours of those shows for up to eight days — all without the broadcasters’ consent.

“Fox has not consented to the recording of its copyrighted programs by Dish, or to the distribution by Dish to its subscribers of copies of all of Fox’s prime time programming for subsequent on-demand, commercial-free viewing,” Fox wrote in its suit.

Dish has also lodged its own federal lawsuit, seeking a declaratory judgement that its service is legal.

If I remember correctly...when cable TV first started the big selling point was NO COMMERCIALS.

Paying for the cable SUBSCRIPTION was enough and they didn't have to show commercials..

I don't get it - if people want to watch commercials then they will - if they don't, then they won't.

Even many new computer games have tweaks that enable the user to skip the opening commercial clips such as the annoying nVidia logos.

Most people have to pay for satellite TV anyway - so if you pay for or have bought a product then you should be able to do whatever the heck you want with it.

Lastly, if I want to watch TV I don't want paid actor idiots with very poor scripts trying to sell me crap I will never want every add break - life insurance ads give me the shits so bad I want to shoot the TV:(

This is why it makes no sense for the major networks to fight internet TV, but rather embrace it. If you watched your program online, they can target advertise you prior to you watching the show...


THey are retarded... they think they are loosing control with internet based tv, when, if they choose too, could have a comanding control, as they have the empire to refocus their energy towards internet tv...



Until they do it, this problem will exist... dumbass consumers also think they need to pay for 300 channels yet only watch 10...

Has anyone noticed the 'delayed' sound volume increase on commercials?

Apparently, on some commercials, they start with the equivalent sound you set, then, after 3-5 seconds the sound doubles or triples.

This is not the 'sound-quality' propaganda urban myth.

This is particularly abusive and I would never patronize one of these products or services that purchase such abuse.

Please you don't either.
