Legal Advice needed Help please
so i work at a restaurant, it just closed cause it wasn't making any money, I have 700 dollars in paychecks approx. A couple other employees said their checks got returned recently. Don't they have to pay us?? Also I believe the bank owns the place now, so maybe they could cash my checks when other banks won't? A little help please GLP. its in Iowa also.

You will have to sue them, hurry before they file bankruptcy or you are screwed.

Quick answer "Eventually"

Long/short answer:

1. bank takes possession
2. bank sells assets(if any)
3. bank settles "outstanding" debts
4. "If" you are high enough on the list, you may get paid

Start doing your homework and getting legal advice for your state and see where you stand...most states have some form of "free" legal counsel if you can't afford your own lawyer

Good luck

You're in the US -- your state must have an office called something like the "Wage and Hour Division", under the "Bureau of Labor" or something.

I think you should call them right now, and they will have better answers for you than anyone on GLP.

Re: Legal Advice needed Help please
The first thing you should do is to try to cash the checks and see what happens. Maybe they will be paid. If not, then contact the Iowa Division of Labor.

The Iowa Division of Labor processes claims relating to unpaid wages, vacation pay, unpaid expenses, unauthorized deductions, minimum wage, etc. If a case cannot be settled or mediated, we may file suit against the employer for wages, liquidated damages, court costs and attorney fees.

Our office does not accept claims for wages after one year from the date the wages became due and payable.

Our office does not accept claims for wages if the amount owed you exceeds $5,000.

Our office does not accept claims for wages if your work was not performed in Iowa.

Q. My employer hasn't paid me wages I believe I am owed. What can I do?

A. If you believe you are owed wages, you can file a wage claim with the Iowa Division of Labor. You can download a Wage Claim Form at

[link to www.iowaworkforce.org]

or request a form be mailed to you by calling 1-800-562-4692. You also have the right to pursue your claim on your own behalf in court.
