Your analogy does not apply to this situation in the least.

He was not forcing anyone. He was peacefully walking down the street.

Your opinion that he was looking for a confrontation does not matter at all.
 Quoting: Anonymous Coward 8597527

I disagree, because if he was a felon and/or on the way to shoot people, the public would be screaming for this cop to lose his job because he didn't at least check to see if the guy had a criminal history.
 Quoting: BRIEF

That's not a valid argument at all. And if he was a felon on his way to shoot people, obviously he would have his gun concealed.

Sorry, this is America. We live under a rule of Law, not Anarchy, where the nervousness of a random party leads to the indefinite suspension of any and all freedom. If you can't handle people peacefully exercising their rights, then maybe you should find a new country.
 Quoting: Anonymous Coward 8597527

That's not a valid argument because I carry concealed and have never done anything wrong...maybe you need a new country...call it lawyersville
 Quoting: BRIEF

In Maine (I live here) it is illegal to conceal carry without a concealed firearm permit, it is perfectly legal however to open carry. He did have the gun holstered. It is also not the law to provide id because there is no law requiring you to carry id in the USA. He was not driving a vehicle and open carrying being legal does not require id either. I have a concealed firearm permit in Maine and because of this I am required to conceal when legally possible where I am.

Fantastic, so doing something unusual is now probable cause for detention, search, and seizure? That's just brilliant.

I don't see many people carrying knives. Can we detain anyone who carries a knife on their belt? After all...You never know.... Could be a felon.

It shows that the police abuses their authority to demand things they have no right to.

No, it shows the police officer was making sure that the man carrying a gun is licensed to do so and this guy is just being cocky with his knowledge of law.

I think it's sad that cops have so abused their authority and so over-stepped their positions of trust that more and more people are unwilling to cut them ANY slack. The police have brought all the disgust many have for them on themselves.

Still (unless the law student was trying to be a YouTube Star -- which I think he clearly was) it would have been so much easier to just show his carry permit. But then he wouldn't have a video titled "Putting A Cop In His Place."

And before anybody cheers . . . what is the cop's place? Is he to sit in his car eating donuts unless he sees some crime committed? If it's 12:30 a.m. and he drives by your house and sees someone in your yard -- but just keeps driving -- because he has no PROOF a crime was committed wouldn't you scream the loudest if that guy had broken in and stolen YOUR stuff. How is the cop supposed to know the guy didn't belong there unless he stops him and asks?!

To me this video is a lose-lose situation.

Fucking sheep. Here I thought that at least some of the people on GLP under-fucking-stood what freedom really is. I think you guys wouldn't know freedom if it bit you on the ass and you wouldn't know your fucking rights if someone wrote them the fuck down and pinned them to your fucking shirt.

This kid did you a favor and you have no idea what it was.

again...its too bad you dont live in the USA where the bill of rights protects you against unreasonable search and seizure, therefore protecting you from ANY search (patdown or not) if you have not committed a crime.

So all you folks who were unfortunate in life to be born in the liberty robbing countries you are currently in, or were dimwitted enough to move there, will never understand what it is to have such GOD given gurantees.

Your opinions mean nothing to those that have seen the better side of liberty and refuse to let them go.
 Quoting: Anonymous Coward 8625162

Amen brother!

just sayin but i don't think i feel comfortable if someone is walking down the street with a gun in his hands...
 Quoting: Anonymous Coward 18665806

^^^You are a brainwashed worm. I'd LOVE to see citizens walk down my street with a gun that is properly holstered. Maybe then my car wouldn't get vandalized twice a year and the grocery stores wouldn't get robbed as much.

who cares about you - stay out of a free country then - chump - if the law says I can open carry then fuck you and your opinion
 Quoting: Anonymous Coward 17858859

To be honest that guy sounds like a right c*nt. I'd be more concerned if the cops didn't stop and query someone why they were walking around openly with a gun.

If it was someone who ended up going postal and killing innocent people, the same people paying out on the cops here would be blaming the cops for not stopping and querying his motives earlier on.

Nothing worse than a screechy little law student who 'knows his rights' but doesn't know how to have a polite conversation with another human being, cop or not.

Not siding with cops, but would have loved to see him get tazed for being a little know it all: then be sent on his merry way.
 Quoting: Anonymous Coward 18679765

Conversation was polite yet firm. The government and the media make it seem like carrying a gun is taboo, but that is a cornerstone of our constitution and bill of rights. Oh wait...wait..right..you don't have that...you live in China.

Just a question since I'm not too familiar with Gun laws.

Aren't you supposed to display your open carry permit badge on you if walking around with a weapon?

At least that's what I'm aware of in Florida

Disregard this comment. Here is a list of Open carry and licence open carry states.

I for one have no issue with open carry as long as it is licenced. I really don't understand those who push non licenced open carry there is nothing wrong with doing a background check on someone and have them carry an open carry badge on them to make sure he is a responsible gun owner

If this kid saw someone walking down the street with a gun I guarantee he would call the cops to be sure that the man had a licence to carry it.  Quoting: KnightsTemplar.TV

HE WAS NOT COMMITTING A CRIME!!! What part of that don't you understand?????
 Quoting: Anonymous Coward 10783814

sherlockNo shit shircock.

It is called probable cause based on the fact he was carrying a gun that "may" or "may not" be licensed. Have you ever heard of probable cause?

Here is an education on law 101 and probable cause.

"Probable" in this case may relate to actual statistical probability, or to a general standard of common behavior and customs.

In United States criminal law, probable cause is the standard by which an officer or agent of the law has the grounds to make an arrest, to conduct a personal or property search, or to obtain a warrant for arrest, etc. when criminal charges are being considered. It is also used to refer to the standard to which a grand jury believes that a crime has been committed. This term comes from the Fourth Amendment of the United States Constitution:

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

"Probable" in this case may relate to actual statistical probability, or to a general standard of common behavior and customs. The context of the word "probable" here is not exclusive to community standards and does not predate statistics, as some have suggested.[1]

FAIL... Try reading some case-law like the individual in the video did... Then you will understand why the police officers could not challenge what he was saying to them and why the Supervisor let him go on about his way..... Notice how they never even got his name & ID from him to see if he was actually a 'felon'? That's because they're not allowed to stop him for the sole reason that he was open carrying - and they realized it.

That was awesome! Great vid Roxy! It sucks that the cop was just doing what he was trained to do. I hate how they all say shit that isn't true. The cop actually seemed like a good guy though. He was not a dick or anything, just doing what he was trained to do. He tried, but the kid knew his laws and rights.
