I respect his opinion a lot, but he is wrong on this one and this is very bad news. The second amendment was not written to provide for hunting or sporting. It was written as a protection and guarantee that if/when the people fell under the tyranny of an out of control government again that they would be able to defend themselves from it. Not living in the 1700s, the weapons and armor of even a simple local SWAT team is way more powerful than anyone with a basic automatic rifle could deal with no matter how much ammunition they had or could fit in a magazine. The balance of power is so lopsidedly in favor of any government agency that Scalia’s foot in the door to further regulation being constitutional (in his opinion) is a crushing betrayal. He was very careful not to say too much, but regulating how much ammunition or what caliber weapon falls under the second amendment is acceptance of the boot heal of government tyranny. Another shocking betrayal from the supreme court. "God forbid we should ever be 20 years without such a rebellion. The people cannot be all, & always, well informed... If they remain quiet under such misconceptions it is a lethargy, the forerunner of death to the public liberty... Let them take arms... What signify a few lives lost in a century or two? The constitution is relatively short and easy to read. It was written at the same time by the same bunch of people. It does not conflict with itself. If you are unsure about what this or that phrase means exactly, you can go to another part of the constitution for more context. The second amendment's phrase "shall not be infringed" for example if much different than the fourth amendment's "unreasonable search and seizure". The second and forth amendments were written by the same people at the same time for the same reasons, so why the difference between "shall not be infringed" and "unreasonable"? It's an easy question with an easy answer. The right to privacy has some limitations. The right to keep and bear arms does not. Take the TV show Cops for example. It is hilarious when they pull over a car over for simple speeding and the driver completely forgets about the joint he's got rolled up stuck above his ear, or the empty beer can in plain sight. If the cop couldn’t see anything illegal he couldn’t search the car without a warrant, but the incriminating evidence in plain sight gives "reasonable" suspicion then to look for more incriminating evidence in the immediate area without a warrant. The second amendment though doesn’t give even a hint of wiggle room for bending. It doesn’t say “shall be respected as much as reasonable” or “shall regulated accordingly”. No, it says “shall not be infringed”. You don’t have to break into someone’s house to infringe on their property. One foot past the property line is an infringement. You could dance all over their front yard infringing and the homeowner wouldn’t know unless he looked outside. That is why the second amendment is worded the way it is.
