I always open carry when I walk my dogs in the woods. One of my friends was in line at Turkey Hill to pay for his gas. A woman from out of state saw his gun and started to freak out. A state Trooper was in line behind him. The woman said to the trooper "that man has a gun!" The trooper smiled and said "he sure does". End of encounter. |

If you're a lone dude openly carrying then you're also a walking target for cops AND criminals. It would take decades after the law passed for it to be normal for every citizen to be strapped and therefore effective at preventing crime because nobody is going to want to start shit then. |

Oh YES they can arrest you for it. That's why I tell them I'm IN TRANSPORT from wherever. Texas thinks as long as your gun in concealed, you are not instigating trouble. That's why we have the concealed handgun permits now. You can't even have a shotgun in a gun rack anymore. It has to be hidden unlike years ago. I'm the guy that back in 1980 had the gun rack in the window with three full spots and so did a lot of other people. Back then every pickup had a gun rack with at least two weapons, a rifle and a shotgun. When is the last time you have seen that in downtown Houston? |

Open carry is not at this time legal in TX, Texas penal code 46.02 and 46.03 are the laws on this, Texas penal code 46.15 provides exceptions to these laws in certain circumstance, one of which is traveling, which is defined as: A person is presumed to be traveling if the person is: (1) in a private motor vehicle; (2) not otherwise engaged in criminal activity, other than a Class C misdemeanor that is a violation of a law or ordinance regulating traffic; (3) not otherwise prohibited by law from possessing a firearm; (4) not a member of a criminal street gang, as defined by Section 71.01; and (5) not carrying a handgun in plain view.
