Fear tactic. They are trying to dissuade people from following the law which has provided a REMEDY for having been fleeced by the banking system.

Bank of America and Chase Bank have already begun mortgage forgiveness and many folks have gotten certified letters from them that thier mortgage has been paid by aggreements of the Atourneys General and global settlements.

Given what's coming our way in this Country in the next few months, my wife and I walked out of our uderwater motgage last month. Fuck it. Throwing away money on a bad mortgage is financial suicide. Good riddance!!!

Got some news for you guys, the GOV can not do one damm thing to you if you walk away AND let the bank know your doing so!!!!!!! They talk the big talk and try to scare people into staying or paying there upside down house note. Truth is people that got screwed by the banks should tell them to puck off and let them know it's there problem.

I remember when we went looking to buy a house, back in 1999, end of that year. The agent hooked me up with a mortgage broker. When we talked to him, we only qualified for 140,000.00 conventional mortgage. But you could still buy a good house for that, just not in the city or super crowded areas, we didn't want that anyway.

So, this guy proceeds to tell me that we can get a much more expensive house, because he can get us a loan where we don't have to show our tax returns or anything else to prove what our income is. This is before all the story came out about the "liar loans".

I was really amazed at this news. But not amazed enough to get into debt so deep I couldn't pay for my place to live.

It would have been easy to say yes to that, also the loan was a variable rate.

We got another agent, bought in another location and went with FHA.

But I can see how tempting it is to get in over your head.

its a complex issue. If the system were not so completely corrupt, then yes it would be right to pay what you owe. Unfortunately the bankers are waging economic warfare on the people. All is fair in love and war. Have no illusions, we are at war with these parasites. They want to implode the economy and take everything of value and consolidate power. People would be able to pay their mortgages if they still had jobs. When the elite do everything in their power to de-industrialize your country, drive out all the jobs, stamp out all the small businesses, then the country will become a third world banana republic, then they can roll in and start exploiting the country more easily because nobody is self sufficient enough to have time to even think about resisting, they will be too busy trying to not starve to death, homeless on the street with the boot of a soldier on their throat.

Strategic defaulters, beware. The feds are coming for you. And they are not happy.

"We are working with Fannie and Freddie to build a mechanism" to identify strategic defaulters, Wolfe said at a recent mortgage industry conference. So if you walked away from one property and bought another, chances are fairly good that the OIG is going to find you.

If you conveniently left off the fact that you have an outstanding mortgage you failed to pay, or that you have a deficiency judgment against you for the difference between what you owe and what the house sold for at foreclosure, you've committed mortgage fraud.

"Debts that haven't been repaid don't just go away," said a Treasury Department official who asked not to be named. "It doesn't matter whether it's on your credit report or not."

If there is any indication that you falsified information on your new loan application, the OIG is "absolutely" going to refer you for criminal prosecution, Wolfe said. "We're not just going to demand repayment," he said. "We're going to lock (people) up."

And if you think the mortgage cops won't find you, think again. The OIG's investigative office alone has a 45-person staff, "all experienced people with 15 to 20 years as investigators and prosecutors," according to Peter Emerzian, deputy inspector general in the Office of Investigations.

They work out of 11 field offices, soon to be 14, nationwide, and they're looking for you.

Why did the banks get bailed out instead of the homeowner?
Why were the banks allowed to even pay one dime as a bonus to it's executives?
Why are the banks not lending money now when home prices are at their lowest?
Why aren't they helping people who are extrememly underwater?
Wht can't a person who is underwater refinance to get a lower rate?

Attorney here, and this guy is right. There is absolutely nothing criminal about walking away from a mortgage, no matter which way you believe.

A contract is (although I don't personally agree) meant to be broken and there is nothing wrong with breaking it. To declare it "illegal" to break a contract would necessitate that you decide to buy a home, sign a contract, get denied financing and then go to jail for not being able to get financing.

What would the bank do if the tables were reversed? I'll tell you. I had a HELOC on my house that I paid my first mortgage off with. When the housing market crashed in Florida Chase sent me a letter freezing my HELOC well below my credit limit. They cited some BS clause in my loan agreement that had nothing to do with a drop in the collateral price of my home. I didn't plan on using the HELOC for anything but the principle of what they'd done pissed me off beyond belief.

Moral of the story, rules only apply one way when you're dealing with a bank. While I believe one should honor their agreements I also think banks should be treated the same way they treat their customers. Fuck them, they'd do it to you.
