Attorney here, and this guy is right. There is absolutely nothing criminal about walking away from a mortgage, no matter which way you believe.

A contract is (although I don't personally agree) meant to be broken and there is nothing wrong with breaking it. To declare it "illegal" to break a contract would necessitate that you decide to buy a home, sign a contract, get denied financing and then go to jail for not being able to get financing.

There really isn't enough of them to come calling for all the defaults. And if a person is in a better situation because of walking away then good for them. The banks certainly got a pat on the back for screwing people. And they got the pat on the back from the people they screwed via their taxes. So if you can better your situation from walking away then DO IT. Life is too short to be a martyr for bankers who could care less about you. Just be wiser the next time and learn from mistakes.

BTW, reality is that this country(really the whole world) looks to be going down the tubes fast. And if you are in a bad situation get out of it as fast as you can and get to a better one before it is too late. Simplify. And if that means ditching an overpriced house then that is what needs to be done. The banks will have your tax bailout and your house. You need to watch out for yourself because no one else will and that includes the banks who are taking care of themselves first and no one second.

You and everyone else has a right to walk away from any mortgage, and the only consequences are foreclosure and possibly a deficiency judgement(that they have to work to try to collect). Even that expires eventually.

For the record, Jon Corzine of MF Global stiffed his investors for 1.2 billion, and he's walking around free and living in a mansion. He violated every statute related to segregated assets and still he's scott free.

"We are working with Fannie and Freddie to build a mechanism" to identify strategic defaulters, Wolfe said at a recent mortgage industry conference. So if you walked away from one property and bought another, chances are fairly good that the OIG is going to find you.

If you conveniently left off the fact that you have an outstanding mortgage you failed to pay, or that you have a deficiency judgment against you for the difference between what you owe and what the house sold for at foreclosure, you've committed mortgage fraud.

"Debts that haven't been repaid don't just go away," said a Treasury Department official who asked not to be named. "It doesn't matter whether it's on your credit report or not."

If there is any indication that you falsified information on your new loan application, the OIG is "absolutely" going to refer you for criminal prosecution, Wolfe said. "We're not just going to demand repayment," he said. "We're going to lock (people) up."

And if you think the mortgage cops won't find you, think again. The OIG's investigative office alone has a 45-person staff, "all experienced people with 15 to 20 years as investigators and prosecutors," according to Peter Emerzian, deputy inspector general in the Office of Investigations.

They work out of 11 field offices, soon to be 14, nationwide, and they're looking for you.

When I did my refi last October, they knew every thing about me that happened for I don't know how many years, at least 7. Maybe the foreclosure falls off the credit report after that many years, but this debacle has only been going on in full force since 2008, that's only 4 years. So what is up?

My mother died and left me and my sister a house. We didn't want to make the payments on it's existing $100k mortgage. But out of respect for Mom's memory and good name, we did. I had a contractor and architect we know refurbish the house. New kitchens, baths, lighting, fixtures, appliances, doors moldings, wood floors, etc. It's a new house inside except it's better than it was when new. I bought Miele Appliances for the kitchen and even got a Miele $7000 fridge freezer on close-out as a demo for $4400 dollars! Granite Countertops and custom closets along with new doors and windows round out the package. I only spent about $40k doing all of the above. (Told you I shopped well!) The baths that the contractor estimated at $4800 for tile and another $1800 for vanity and another $1300 for plumbing I managed to get done for a total of 2200 dollars for both baths! Some friends bought a NYC brownstone and ripped out a 2 year old Clive Christanson kitchen (very high end - this was 100k for the cabinets alone when it was installed 2 years ago.) I bought it all for the cost of removal and shipping. That cost me about $4500 to have it taken out, boxed, wrapped and shipped to Arizona. We used about 1/2 the cabinets I bought in the kitchen redo and I have another kitchen's worth in storage. I could not dream of affording one of these super-high end kitchens normally. But I paid for the whole thing LESS than the cost of super cheap cardboard kitchen from IKea! The cabinet installer I used had worked on Clive Christianson Kitchen's in NYC and in LA and was in awe of their workmanship. He loved putting them in and although he had to slightly modify one face frame to fit our new Miele Ovens, it went like a charm. The new cabinets and most of the major appliances were in and working about four days after they arrived.

Bottom line is that the house just appraised for some 110k more than we owe on it, or 60-70 k more than we put into it.

Sometimes dong the "right thing" pays off handsomely. While housing in other parts of the country is still in the toilet, these houses have rebounded - although not to their 2008 insane levels. But they've come up by double their all time low back in 2009/10. The fact that we redid it helped too. By a LOT!

Take the honest person that paid 1.3 million dollars for a home in the market that the greedy bankers made up.

Then the market crashed and the home is only worth 500k now.


What is the point of paying for 800k more for a home that is not worth that much anymore?

Of course people walked away. The Greedy fucking bankers left a lot of bag holders out there.


I understand if somebody lied on their mortgage application...which they would have to do after walking away from another mortgage....they are in trouble for fraud.

But I would LOVE to see these 45 people hunt down these loans.

These loans were bought and sold so many times, repackaged and stamped AAA and sent out abroad the original loan could be held by a Dutch bank that defaulted.


They are gonna have a hard time.

Oh fucking please. They'll be lucky to get convictions for the very worst cases of people walking away from mortgages they were barely if at all underwater with and who turned around and bought a foreclosed home with a mortgage in which the application was fraudelent. They will NOT be throwing people in jail who simply walked away from underwater mortgages.

My mother died and left me and my sister a house. We didn't want to make the payments on it's existing $100k mortgage. But out of respect for Mom's memory and good name, we did. I had a contractor and architect we know refurbish the house. New kitchens, baths, lighting, fixtures, appliances, doors moldings, wood floors, etc. It's a new house inside except it's better than it was when new. I bought Miele Appliances for the kitchen and even got a Miele $7000 fridge freezer on close-out as a demo for $4400 dollars! Granite Countertops and custom closets along with new doors and windows round out the package. I only spent about $40k doing all of the above. (Told you I shopped well!) The baths that the contractor estimated at $4800 for tile and another $1800 for vanity and another $1300 for plumbing I managed to get done for a total of 2200 dollars for both baths! Some friends bought a NYC brownstone and ripped out a 2 year old Clive Christanson kitchen (very high end - this was 100k for the cabinets alone when it was installed 2 years ago.) I bought it all for the cost of removal and shipping. That cost me about $4500 to have it taken out, boxed, wrapped and shipped to Arizona. We used about 1/2 the cabinets I bought in the kitchen redo and I have another kitchen's worth in storage. I could not dream of affording one of these super-high end kitchens normally. But I paid for the whole thing LESS than the cost of super cheap cardboard kitchen from IKea! The cabinet installer I used had worked on Clive Christianson Kitchen's in NYC and in LA and was in awe of their workmanship. He loved putting them in and although he had to slightly modify one face frame to fit our new Miele Ovens, it went like a charm. The new cabinets and most of the major appliances were in and working about four days after they arrived.

Bottom line is that the house just appraised for some 110k more than we owe on it, or 60-70 k more than we put into it.

Sometimes dong the "right thing" pays off handsomely. While housing in other parts of the country is still in the toilet, these houses have rebounded - although not to their 2008 insane levels. But they've come up by double their all time low back in 2009/10. The fact that we redid it helped too. By a LOT!
