Even then, I believe you would have to have a notice of default -- and been provided with the default amount -- and not included this in your second loan application - in order to be in trouble. There are a lot of people who stayed current on their mortgage for a house they were upside down on, bought a new home at a lower price after the market crashed, on credit... then defaulted on the first house. I believe they are in the clear as well because they did not lie on the loan application for the second home. Have a nice day = GFY. GFY = Go Fuck Yourself. That would be like walking away from your car, you still own it and are responsible for it. If i owe the bank money (house, car, whatever) they expect to get their money back at some point. If i would owe more than the house is worth, i can't just walk away. The police would get me if i tried. But if i were under water i could still continue to live in the house as long as i paid every month. Almost everyone pays interest only, so the monthly payments are not as large like in America. |

I guess it would depend on the situation... I would vote to charge someone who had the intention to commit fraud - someone who knew when they signed the application exactly what they were doing -- but would have a hard time going against the homeowner who was simply wanting to buy a home and really did not understand their situation. I am sure there are a lot of people who were trying to stay in their home -- were evicted anyway -- and needed a place for their family so bought another home without fully understaning their financial/legal obligations. I don't believe a person should have to live with something the banks wouldn't live with. And if that means walking away from a situation the banks caused then so be it. Again, they have financial repercussions when doing this. But I do not believe messing up a person's whole life for a mistake they made that had the stamp of approval from greedy banks. Everyone needs a get out of jail free card at least once in their lives. Just because they can afford an albatross doesn't mean they should be stuck with it for the rest of their lives.
