this is actually the only reason I voted Romney however I wouldn't really call Kennedy a conservative.

The court is 4 conservative, 4 liberal who are hugely divided and 1 swing vote which is Kennedy.

And people more conservative than I would argue that Roberts is also not conservative considering he gave us Obamacare.

However it is pretty hard to argue that Scalia especially, but also Alito and Thomas are not conservative.

Obama of course appointed two ultra libs in Kagan and Sotomayer.
