Quoting: Herman The Kid This is not what it is being made out to be. Pretend you are rightfully convicted of selling crack. Part of your probation states that you can't advertise that you are "holding" to anyone in any fashion. You tweet, "Hey guys, I just loaded up on CRACKing HTML code and I have plenty of it to go 'round." This is tantamount to what she did regarding free speech. But she is not selling an illegal substance. She is simply making a statement, however tasteless it may be. I definitely think this is a violation of her right to free speech. Oh....what was that? Free Speech? Oh never mind. Go back to sleep, it doesn't matter. I usually think the same thing and you have no idea how many hours of my life I've spent fighting this but I am sure, she is in the wrong on this one-I am certainly not "asleep." Oh no I didn't mean you, I was generalizing about the snoozing. ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~ Resident Led Zeppelin Expert (ask me anything!) She later posted the following comment on Facebook: “My dumb (expletive) got a DUI and hit a car LOL.” A judge ordered her to take down her Facebook page, and when Asher did not comply, she was held in contempt of court and ordered to spend two days in jail." that cannot be legal to arrest someone for saying that??? Interesting post, but I don't know what to say! Apparently no one else does as well. I don't see where a judge has the right to force someone to delete their Facebook account, maybe the post if that was the problem but not the account. Sounds like the judge was a power hungry prick. Quoting: Anonymous Coward 21746158 time to get on the horn with the ACLU, sounds like to me. more like refusing a bail condition, which can be varied widely for individual cases. as per usual here, the thread title is wrong and indicitave of weak material the linked article says she did 48hrs jail time for failing to comply when ordered to remove the comment, after a dui, not for posting 'LOL' as op wishes you to think. good example of how religions work and peoples thoughts are manipulated, so the negative aspect of an obvious bullshit thread affecting others on the board is somewhat offset by the exposure of op's rather feeble attempts at having you believe want they want you to. |
Biochemky User ID: 919411 United States 09/28/2012 01:15 AM Report Abusive Post Report Copyright Violation | The judge was in error. He clearly overstepped his legal authority. He infringed on the woman's constitutional right to free speech by demanding she take down her facebook page as part of the terms of her probation. She was within her rights to fail to comply with a legal order that is unconstitutional. She should engage the ACLU to sue the county state, or federal court system (whichever the case may be) and the judge personally for having abridged her civil rights (her constitutional right to free speech). No, this is not legal "in Kentucky". |

Quoting: Anonymous Coward 24420062 When arrested she was found to be intoxicated and in possession of narcotics. While awaiting trial she made several insulting remarks about the witnesses ( the four teenagers she hit) and bragged repeatedly about how mcuh she drinks on FB For reasons i cant figure out the judge went easy on her , All she had to do was attend rehab and DELETE her FB account as a condition of her release. She never deleted her account ( kept using it ) so the judge threw her ass in jail for a few days. The judge had NO right to order her to delete her facebook page. He's an asshole for doing that, and belongs in prison. |
