STATEMENT BY SENATORS McCAIN, GRAHAM AND AYOTTE ON OBAMA ADMINISTRATION GUIDANCE ON SEQUESTRATION LAYOFF NOTICES

September 28, 2012

Washington, D.C. ­– U.S. Senators John McCain (R-AZ), Lindsey Graham (R-SC) and Kelly Ayotte (R-NH) released the following statement on Obama Administration guidance issued today instructing defense companies and other government contractors not to issue mass layoff notices to their employees, as is required under the WARN Act, in anticipation of the $109 billion in across-the-board budget cuts scheduled to occur under sequestration on January 2, 2013:

“Today, President Obama put his own reelection ahead of the interests of working Americans and our national security by promising government contractors that their salary and liability costs will be covered at taxpayer expense if they do not follow the law that requires advance warning to employees of jobs that may be lost due to sequestration...

..“Facing intense lobbying by defense companies and other government contractors for financial protection if they agreed not to issue WARN notices, the Obama Administration is giving contractors a free pass and will have potentially stuck the taxpayers with a multi-billion dollar campaign contribution.... As a result of the OMB guidance, the Department of Defense will have to allow companies to claim repayment for the salaries of workers who are laid off but did not receive the required WARN notices – a cost to the taxpayer that could be as much as $4 billion.

In addition, DOD will have to reimburse companies for any legal damages paid to workers who are laid off but did not receive the required WARN notices – a cost that is inestimable.

NEW YORK (CNNMoney) -- The White House on Friday told government contractors worried about fiscal cliff spending cuts to hold off on warning employees about possible layoffs.
The government said it would cover legal costs if contractors are forced to slash their payrolls because of the looming $109 billion in automatic cuts next year and are alleged to have violated the WARN Act.

The federal WARN Act requires businesses with more than 100 employees to notify workers at least 60 days in advance of a mass layoff or plant closing. Some states require more notice.
"Any resulting employee compensation costs for WARN Act liability as determined by a court, as well as attorneys' fees and other litigation costs (irrespective of litigation outcome) would qualify as allowable costs and be covered by the contracting agency, if otherwise reasonable and allocable," the Office of Management and Budget said in its guidance...

..In a memo to senior finance and procurement officials at agencies, Danny Werfel, OMB’s controller, and Joseph Jordan, head of the Office of Federal Procurement Policy, expanded on guidance provided by Labor in July about layoff notices.

In that guidance, Labor officials said contractors should not send warnings of impending layoff notices to their employees in advance of a potential budget sequester in January. Such notices, they said, are not required under the 1988 Worker Adjustment Retraining Notification Act, and in fact are “inconsistent” with the law, according to a policy letter to state workforce agencies issued by Labor officials.

Contractors have expressed concern that the WARN Act, which requires companies to provide 60-day notice to employees of impending mass layoffs, might apply to a budget sequester that could slash federal agencies’ budgets. Labor’s Employment and Training Administration said it does not, largely because it is not clear yet -- and may not be clear until the last minute -- whether a sequester actually will go into effect.

An industry souce said the OMB memo seems to acknowledge that adherence with the Labor memo is in conflict with WARN Act compliance.

"Why else would they issue guidance specifically stating that if a company followed this administration's guidance about WARN Act compliance, it would have any labor related legal fees and judgments made allowable costs, also?" the source said. "Many companies are worried about that legal obligation and that is motivating them to pursue compliance despite the Labor memo."

When a company does not give a Warn notice they (the company) will have to pay the worker 60 days of pay and benefits, following the lay off. Under normal circumstances an employer provides a Warn Notice to employees, notifies state work force development/unemployment bureau and local goverment of the pending mass layoff. The company will be on the hook!!!
