Based on the language of the proposed bill that has the words “person owns, controls” caused me to do some additional research on “who owns the property when it is mortgaged.”

While I trust nothing on the WWW when it comes to legal issues, I did find something that makes me take pause …

In some states, known as "title theory" states, the lender keeps the title and owns the house until the borrower pays off the loan. In "lien theory" states, the borrower holds the title and owns the house, but the mortgage note gives the lender the right to seize and sell the house for non-payment.

If Ohio is a “Title Theory” State, then this proposed law could mean that the mortgage holder would need to provide permission to have a gun on “their” property.

If you rent or lease property it should be your property within the rental or lease period and you should be able to use it as you wish. I own private property and I do not want people coming onto it with guns. I do get an occasional stray hunter and that's ok because I know what they're doing. Random people from the world, no stay away!

Another reason I'm glad I live in Tennessee. Coming back from the range yesterday, I stopped into Krogers before going home. I was open carrying a Tarus Judge (.45/.410) and no one even batted an eye.

Also be aware there have been cases where juries have found someone not guilty of the main charges and guilty of lesser charges.

And because the judge disagreed with the verdict gave a heavy punitive sentence for the lesser charge.

It is an end run around the intent of a jury.

So we have a bill that would effectively ban having a gun in any way if you do not own the property without written permission and at the same time we have the department of housing and urban development getting in to the rental game. No way will the government give you permission that is for sure.

And yes the bill says you can have a gun with oral or written permission, but we all know oral will not cut it if you have to go to court, the landlord could flip flop on you and then you’re in serious trouble, so you NEED written permission to have a gun.


Then the one AC brings up a great point, do you or does the bank holding your note own your house,? Will you need permission from the bank if you have a house payment? No way a bank would say you can have a gun, puts them in a legal position, they will never do it for anyone.
