The banks figure people under water on their martgages are
probably going to walk anyway, so the banks are trying to get what they can now. If this is really going on, it
probably indicates the banks don't see any recovery in home values anytime soon, hence homeowners walking away from mortgages. Banks make much more from mortgage payments than through holding real estate.

The criminal banks are now stealing people's properties who have never been late on a payment! How? Through "appraisals"! They are requiring homeowners and commercial property owners have new appraisals. When those appraisals (in cohorts with the appraisers in getting them low) come back lower than the loan amount, at the property owners expense.

They give the property owner 30 days to pay the difference of loan to value of the property otherwise they take over the property and kick the owners out! They are doing it to homeowners and commercial property owners!

Typically the only clause like this in current mortgage doc's are "due on sale" clause. Basically if you sell your home on a Land contract the lender can actually demand repayment. None of them do however.

The Truth in Lending disclosure will specifically state whether there is a "demand feature" on the loan.

thought the banks provided the initial appraisals before the loans are dealt with (in order to get a loan they appraise it)

if anything comes out of this they should be the ones paying if they over appraised a property - it sounds like fraud again

Yes, if you read the bazillion-page "fine print" section, it's in there. It was in OUR home mortgage paperwork over 25 years ago.

Have you noticed at all, there are so many ads on TV for re-financing at a lower interest rate, or even those "reverse mortgages". I'm probably an old fuddy-duddy, but those types of things make me nervous. Yes, you may get a lower interest rate than what you're paying now, but what does that figure out to? 50 or 100 bucks a month? Meanwhile, you are starting back at "Ground Zero" as far as paying back your loan. How old will you be in 30 years? If you are in your 20's or 30's, it might be a good idea. But if you're in your 50's or 60's, think about how old you'd be.

And this gives them an opportunity to re-appraise/re-evaluate your property, and perhaps they'll only consent to loan you a lot less than you wanted or needed. They can actually eyeball your property, make a note of it and create a file for it, and if they want it badly enough they can figure out how to "eminent domain" it for a future shopping center or a freeway which isn't scheduled to be built for another 10 years (but they grab your property NOW when they can pay you the least amount possible because of the crappy market).

Just my 2 cents worth, but I say, why bring yourself to their attention - that's the last thing ANYONE should want to do especially now when things are so uncertain and shaky.

itis better to stay home in mom's basement; save the money and buy a starter property with cash, like a little oneroom thing with a couple acres, where the taxes are low. Then start adding on to the oneroom thingy, at the cost of a monthly payment had you gotten a mortgage.

This is happening to two friends of mine. They both applied to refinance. They made all their payments but the bank was (unknown to them) charging each month for walk throughs and appraisals that were never done. Each month they were getting further and further behind (even though they were making their regular monthly payments). One has filed for a halt on the sheriffs sale. He went to court last week with copies from his bank showing each month's auto withdrawal of the mortgage. The judge was furious. Her exact words were "Not In Louisiana". She gave the mortgage company 30 days to explain these hidden fees and why the payments were applied to them and not the note.

I've worked in law 35 years.

I have read thousands of mortgages and promissory notes and have never seen one that had language allowing the bank to call a loan when the value of the security declined below the amount owed on the note. If someone has one with that specific language, I'd like to see it posted here.

What is nice is when you get pull over for a traffic violation, you just pull out a few dollars/pesos and problem is gone.. In two minutes your driving off and don't have to bother with court or higher insurance payments...

That sounds like a great idea. The offender pays a fine on the spot - no wasting time and money on court costs and bureaucracy. The cop gets a nice little bonus for doing his job. Everybody wins.
