GRAND RAPIDS, MI – Federal prosecutors on Wednesday, Nov. 7, rejected the notion that Steven Deuman, convicted of killing his infant daughter while raping her, deserved a new trial.

The defense had asked U.S. District Judge Gordon Quist for an acquittal or new trial in the Aug. 12, 2010, death of 15-week-old Evelynne Deuman. She died in their home on an American Indian reservation in Suttons Bay, near Traverse City.

Prosecutors say the girl was asphyxiated during oral sex, but the defense says she accidentally choked on a discarded condom.

Steven Deuman was caring for the girl by himself. He said he put her on his bed while he stepped out for a cigarette, and found her on the floor, bleeding, when he returned.
The defense said that the condom contained Evelynne Deuman’s DNA on the outside, and the DNA of her parents, Deuman and Natasha Maitland, which is “consistent with (Evelynne) choking on a used condom,” attorney Richard Stroba wrote.

He said the lack of injuries to the girl “points to accidental death.”

Assistant U.S. Attorney Phil Green, who, after the verdict called the case “as heinous as it gets,” said in court records that the evidence showed Deuman killed his daughter while orally raping her.

“ As (Deuman) himself admitted, (Evelynne) was incapable of rolling over or grasping items on her own; much less could she crawl over the mound of pillows and blankets the defendant says he used to surround her after placing her in the middle of a queen-size bed,” Green wrote.

“The forensic evidence establishes that the used condom, found across the bedroom under a diaper, had been in (the girl’s) mouth."

He said the girl's DNA was not found inside the condom, "refuting the defense contention that (she) sucked the entire condom into her throat and died."

Green said Deuman exhibited signs of having a guilty conscience, and “once he realized his efforts to shift blame to others was for naught, the defendant made a number of incriminating statements concerning (her) death, including that his body must have done it, that he was possessed by evil spirits, and that he blacked out.”

The case was handled in federal court because the killing occurred on an American Indian reservation on land held in trust by the U.S. for the Grand Traverse Band of Ottawa and Chippewa Indians.
