The biographer for resigning CIA Director David Petraeus is under FBI investigation for improperly trying to access his email and possibly gaining access to classified information, law enforcement officials told NBC News on Friday.

The law enforcement officials said they do not believe the FBI investigation will result in any criminal charges. They also stressed that Petraeus is not under investigation.

At some point after Petraeus was sworn in as CIA director on Sept. 6, 2011, the woman broke up with him. However, Petraeus continued to pursue her, sending her thousands of emails over the last several months, raising even more questions about his judgment.

“The decision was made to delay the resignation apparently to avoid potential embarrassment to the president before the election,” an FBI source says. “To leave him in such a sensitive position where he was vulnerable to potential blackmail for months compromised our security and is inexcusable.”

They don't have jurisdiction... If he was a traitor w/I the DOD he would be investigated by one of the myriad DOD investigative agencies & he would be tried under the UCMJ....

The US Military has its own justice system... An active duty general would be investigated by DOD agencies & if criminal misconduct is alleged he would be prosecuted under the military justice system...

Note - DOD civil matters are also investigated by the DOD investigative agencies - not FBI

Get the issue? The FBI investigates civilians... So, if this came out due to an FBI investigation, and he was the subject of the investigation, it most have related to his actions after he retired from the military...

The FBI investigates acting heads of the CIA? That doesnt sound right. Evenso, you'd think that he would have had insiders in the FBI informing him.

Getting "extra-marital-affaired" might be better than getting "heart-attacked", for the time being at least,

but if he is getting falsely set up then what comes more to mind is how many are on his side in the CIA, and what beliefs and intentions does he carry in his administration.
