And the US constitution says you can replace the gov as well.. but again, does an online petition do this?

LOL no..

You will still need to file legal paperwork, or go to war... .

How does this online petition estabiash a goverment? who will run it? or will texas try to run with no central gov?

will the people over through those in Austin? force them to resign then estabish texas as a nation?

Does signing an online petition do all of this..

Keyboard ninjas..

Even if Texas has every legal right to withdraw from the Union the United States wouldn't let it happen end of story.

You Idiot. Learn History. States cannot secede from the Union. Period. That issue was put to rest when the Union won the Civil War.

Do you think the government would be able to raise an army seriously to put down a secession from our armed forces?

I frankly think it would only widen the conflict.

Re: Texas will not leave the union...
No, Texas has no right to secede. It doesn't matter whether it's in Texas law or not. This was all decided long ago, in the 14th amendment. Here's a paper on that:

[link to papers.ssrn.com]

Here's a quote: "Second, no state can deprive any American citizen of the privileges or immunities of citizenship — which means, for example, that the state cannot deprive a citizen of U.S. citizenship by seceding.12 The Privileges or Immunities Clause explicitly prohibits a state from depriving citizens of their federal rights, and secession would be a blatant violation of that prohibition.

However, there are still two routes where secession, at least of a sort, MIGHT be sorta doable. First, a constitutional amendment. That would require ratification by all states. If the required percentage (2/3 I think?) of states ratified Texas leaving the union, then it could be done that way. That would be the best way, since all the details could be worked out, like those who don't WANT to leave behind the United States could be given residence elsewhere, specify where and how that works, etc.

Alternately, everyone in Texas could simply leave the United States, including Texas. That requires no constitutional amendment; people just move to another country.

Those are the only ways. Signing petitions in Texas accomplishes nothing. That's just a charade, a dream that will never see reality. If Texas wants to secede, then they will need to convince the majority of states in the union that Texas leaving the union would be best. Or everyone in Texas can simply leave the United States (including Texas). Not quite the same thing, but doesn't require any constitutional amendment either.

You forgot another alternative.

A Constitutional Convention would require ratification of the citizens of the STATE to join a new union based on a new Constitution.

Texas could simply refuse to join the new Union after a Constitutional Convention.

37 States are needed to call a Constitutional Convention .... 35 have already passed legislation for this purpose. Thus - after 2 more state legislatures make the call for a convention, and the libtards screw it up....

There will be three to five governments created because none will agree with the "progressive" PC Constitution that comes from libtards.

Texas, Oklahoma, and Louisiana will join together ... and will control almost all energy imported into the former United States. They will make the yankees pay out the ass for energy.

Russis and Texas are natural allies. We'll have a mutual defense treaty with Russia and allow Russian ships and subs to dock in Port Aransas and Galveston, not to mention the use of former US bases Fort Hood, and Randolf AFB.

And we'll elect Ron Paul as our first President.

Take that bitches.

A convention means they get together and discuss things. That's really it. So, they have a convention, and they toss out: 'Do you agree with Texas seceding from the union?' 17 or more states vote no, so that's done, Texas stays. And on and on it goes, state by state, until...hey, everyone stays. Okay, next order of business. Meet again in 10 years to discuss things again? Sure, sounds good. Let's go get some lattes now!

Okay I got really bored reading what everyone was saying but both sides are correct on many terms. Texas leave the Union for the people who havnt leaved or didnt take texas history are idiots and dont know what they are talking about. it may state that they cant but they can :P and i truly dont think US will allow texas or the other 17 states to leave the union. texas is one of the top providers or eco. things. and if the really wanted to leave they could and if they do and the us doesnt like it im sure all 18 states will start a war with us which then will turn out to ww3. (im half asleep sorry for my miss spelling and lower class words)

Texas isn't going to secede.

There's more than 25 million people in Texas, and I'm gonna go ahead and say that not even 1/4 of them would be in favor of secession.

Hey, cowboy, the Union left TEXAS. Any secession of TX is just to remind the Fed Criminal Government that it doesn't call the shots. The Fed is an admiralty law weilding 10-mile square piece of land called the District of Columbia. It is NOT THE LEGAL UNITED STATES OF AMERICA GOVERNMENT.

Get a clue.

You have been seized and conquered by international bankers who intend to gut you and destroy Texas and take every penny of your wealth and leave you dead.

That's their plan.

FACT

So, fuckin' A, yes, secession -- just like Iceland did. Arrest the fucking criminal bankers and abrogate any law, treaty, or other legislative action they have ever done. Revert and restore to the United States Constitution as the complete and only law of the land.

Not that long ago, it was Perry himself who attempted to start a secessionist movement in this state . . . would be interesting to know what happened to make him so definitively change his tune.

America would not fare well without the support of Texas.
