Dont you all get it? If you choose with intent to survive in the society, you consent to its laws and punishments, stated or not. If you wish to not be apart, live in the wild or another counrty. That is not consenting. Once you rely on any form of it, you are enslaved to it.

I was charged with misdemeanor "obstructing a peace officer" for simple saying "I do not consent" and rolling up my window.

TRUST me, I know a LOT more about the system than you do. I spent 2 years full time reading all of the alternative law stuff and then one day, I decided to test it.

I took it in the ass.

All of you people are making a LOT of assumptions, but I am asking a simple question on a parallel subject.

Keep your assumptions and post INFORMATION.
 Quoting: Anonymous Coward 27384624

in your OP, you say "this was a traffic violation contest". i didnt make any assumptions, i went with the bullshit YOU provided. misdemeanor obstruction ISN'T a traffic violation, dickhead. so, how about this: pony up as much pertinent info as you can (like jurisdiction, actual code you were charged with, any additional charges you might have "neglected" to mention), and you might actually get some pertinent input. or maybe you thought fucking kreskin was going to respond to your post?
 Quoting: Anonymous Coward 27573720

It was a traffic stop. I refused to consent and was hauled in. The misdemeanor ("criminal") charge was added later by overzealous prosecutors.

So, try to refrain from injecting your ego into the discussion.
 Quoting: Anonymous Coward 27384624

Hello is there anybody in there?

You refused to consent but you already consented with your driver license

You already agreed to their system by signing your driver license

Yes in their warped minds you consented even though you didn't because there was no full disclosure

Either pay the fine or disappear off the radar
 Quoting: Anonymous Coward 26551418

You are not paying close enough attention.

My license was signed "without prejudice" and the state was notified of that fact for one year prior.

It is now "criminal" in my state to not have a valid license with you.

This just underscores my point that it does not matter what you do anymore, the system will proceed over your "non-consent" and EVERYTHING else you try to do.

This all happened 3 years ago, but I fought so hard that it drug out in court for 2+ years. I went through 3 judges and 6 prosecutors. Got almost everything dismissed except they clung like wolves to the "obstruction" charge, which was totally bogus.

In the end, they brought in a "guest judge" from out of town and stuffed me in an unused, unfinished court room at the end of the hall and WHAM BAM, conviction. I ruffled so many feathers, that the actual District Attorney's personal deputy came all the way from the down town office to railroad my ass.

Then, I bargained the judge out of my sentence, lol. Bet you sheeple didn't know you could do THAT?!

I simply didn't consent to the sentence and she said OK! I talked her down to 6 months' probation and some community service and no fines. She as talking $1000 and jail time at first, lol. CASE CLOSED.

But then, two weeks later, I got a letter with an "Amended sentence" for thousands of dollars.

This is, of course, utterly illegal. My probation officer told me emphatically that I had pissed off "somebody important" and that I should not try to fight it, no matter how illegal it was.

Rule #l

In their world a driver license = CONSENT

Rule #2

Talk to a statute enforcer is CONSENT

Rule #3

There is NO CONSENT unless there is FULL DISCLOSURE

There has never been full disclosure which means their system is NULL & VOID

If you are a citizen of the United States, its laws pertain to you, regardless if you think they are "fair" or not. That makes you one of the people, the prosecutor was obviously wrong, but so were you.

However, a foreign national is not under the jurisdiction of American officials, but if they go that route - none of the protections are valid either. A double edged sword at best.

Re: District prosecutor told me I was NOT "one of the people" as written in the Constitution.
The CON-stitutions, both federal & state ONLY applies to persons or their agents that hold political office... IOW, the constitutions are limitations upon governmental powers.... since you are not in political office or an agent of a political office holder, the constitutions do not apply to you.... note the so-called bill of rights... it doesnt give you rights... it merely provides for rules that prohibits the government & its agents from exercising certain powers that are inimical to the concepts of liberty as contained in the organic charter..... when you try to stand employing the constitution you MUST insure that your natural human rights are antecedent prior to the formation of any government.... and note on the record that it is THEY as government actors who must abide by the rules, conditions & limitations of the constitutions... NOT YOU! Hence you must use great discretion & care in the use of language, for they will attempt to trick you into covertly admitting that you are a political office holder and\or agent thereof, and once that happens you are subject not only to their rules, codes & regulations but also to the 4th branch statutory jurisdiction where only limited privileges exist by statute.... NOT LEGAL ADVICE, ENTERTAINMENT ONLY!

Re: District prosecutor told me I was NOT "one of the people" as written in the Constitution.
I am looking for a person who knows much more about the REALITY of this subject - not speculation.

When the prosecutor said this, I pursued the question as to why, etc. and she stonewalled me. I was VERY persistent and I could see her armpits soak through her shirt.

Finally she got up and left the room and sent a different deputy prosecutor in to see me. This was a traffic violation contest.

Anyway, I am a natural born American who has served in the military, etc.

If I am not one of "the people" refered to as "We, the people" in the State and Federal Constitution, then WHAT THE FUCK AM I?

This would mean that those documents are no applicable and that I (you, we...) have NO rights whatsoever. And, all court cases on that subject are just dog and pony shows.

I can assure you %100 that this happened in real life. I want to speak with somebody who KNOWS how and why this is so.

It is a game-changer, obviously.

Where are some REAL documents I can look up (in a library) that explain this phenomenon?

THANKS!

WHAT?? She is wrong, wrong wrong. You ARE the PEOPLE - we ALL are. Shame on her for saying this to you.

You need look no farther than the Constitution of your state and the federal one - you are CLEARLY a part of the "PEOPLE".

What law school did she graduate from?? Lawyers-R-Us?

Re: District prosecutor told me I was NOT "one of the people" as written in the Constitution.
Put it this way

Nobody has jurisdiction over you because you have never consented to anything

But what did you do?

You talked to them which in their world = CONSENT
 Quoting: Anonymous Coward 26551418

That's simply not true.

If you don't talk, you'll get tazered and dumped off in jail. Trust me, I know. I did it.

CONSENT is not required in this fascist system.

Anybody who says otherwise in SELLING SOMETHING.

Also, on this subject I have to deal with a lot of male egos who bought into the "strawman" idea and cannot be convinced that they are not right (because they paid money and time to "learn" about it.)

To all of you: I challenge you to go get arrested and then try to get off the hook using strawman BS. Go ahead, I'll wait.
 Quoting: Anonymous Coward 27384624

Guys, this strawman stuff is just that - BS. It's a way tot ry and twist the law into a pretzle to make it fit a person's desire to be "free" or the corporation. None of it, none of it, has any basis in our modern system of jurisprudence.

You will have a much better time finding errors in procedure and substance, rather than trying to make the argument that the state has no legal right when it comes to you as a person.

The constitution only pertains to signatories of the document

WRONG.

Explain or GTFO
 Quoting: Anonymous Coward 27384624
The Constitution is a contract, a contract which you are not party to because your name is not on it. it does not apply to you as when you are in court you are there as a corporate entity using documents issued by another corporate entity . Forget all the freeman crap ans sovereign citizen bullshit. its all about contracts .. drivers license? thats a contract you entered into by exchanging your right travel for a privelege (license) to drive. Driving is legally defined as a commercial activity and therefore regulated. Traveling is not a commercial activity and not to be regulated . The UCC is the law of the land in regards to administrative and contractual matters. Check it out..

Re: District prosecutor told me I was NOT "one of the people" as written in the Constitution.
You may want to do some research into:

February 21, 1871 with the Forty-First Congress in session an Act was passed*. The title was "An Act To Provide A Government for the District of Columbia" also known as the "Act of 1871."

A SEPARATE CONSTITUTION was created after the Civil War which made you a SUBJECT.

So technically the prosecutor was correct, you are not a citizen as defined in 'we, the people' anymore...

When a lawyer goes to take the bar, they must SWEAR AN OATH to the 'corporation of the United States'...

The entire system is illegitimate... You really think the Civil War was fought over slavery?

Those that won the war simply re-wrote history.

Read all about the SCAM of 1871 here:

Where is a contract without your signature?

There is no consent without full disclosure and a signature
 Quoting: Anonymous Coward 26551418

Birth Cirtificate. It was signed by both or one parents giving the power of consent for your at birth.
 Quoting: Anonymous Coward 9026665

That's not consent from me. It means nothing
 Quoting: Anonymous Coward 26551418

Were my parents given full disclosure when they signed the birth certificate

NOPE

no full disclosure = NO CONSENT = NO CONTRACT
 Quoting: Anonymous Coward 26551418
yes, any contract entered into without full disclosure of all ramifications of said contract by the party offering the contract is considered "void ab initio"
The problem lies in the fact that if you do not reserve your rights from the very beginning of contractual negotiation you are legally considered to have forfeited your rights

NOT LEGAL ADVICE, ENTERTAINMENT ONLY!

in your OP, you say "this was a traffic violation contest". i didnt make any assumptions, i went with the bullshit YOU provided. misdemeanor obstruction ISN'T a traffic violation, dickhead. so, how about this: pony up as much pertinent info as you can (like jurisdiction, actual code you were charged with, any additional charges you might have "neglected" to mention), and you might actually get some pertinent input. or maybe you thought fucking kreskin was going to respond to your post?

 Quoting: Anonymous Coward 27384624
Did you or did you not sign the tickets with a UCC reservation of rights? If you didnt then that is how they got you , you signed and consented to a non-negotiable instrument. you have to reserve your rights on EVERY piece of paper because everything you sign IS a contract.
