i don't give a shit if a 5 year old is stealing a candy bar. the little fuck is a criminal piece of shit and should be tried as an adult.

When he spends a few weeks in adult prison I guarantee he won't want to steal anymore, granted he survives. But they have protective custody now so he would be fine.

Little punk would probably just cry for his mommy a lot.

For serious stuff like murder, older teens should be tried like adults. No need to give the young psychopaths a get out of jail free card.

But for anything less serious, we should treat them like children and work to rehabilitate them. Many young criminals come from nasty homes, and need a chance to learn to live a better life.

Re: Survey, Do you think children under the age of 18 should be tried as adults?
I think it depends on the crime... if it was premeditated murder, rape and like things, then yes, they should be tried as an adult... but if it's just something tupid like a drug related charge the First Time, no I don't think that they should be tried as an adult. I remember there was a story a couple of years ago, where 2 brothers that were as evil as they come (killing animals, throwing rocks at thouses and people, etc...), the parents and courts could do nothing to keep those 2 boys in line, getting in to "trouble" didn't fase those 2, but then they went and tortured a little boy to death, and then finally were tried as adults and should serve I believe life behind bars. They were truly evil little boys, I think one was 10 and the other like 12. Their whole town was relieved when the 2 were put behind bars.
 Quoting: Anonymous Coward 26295520

Thanks! I think that the parents of the child should be in some sort of trouble as well, don't you think?
 Quoting: Anonymous Coward 24966684

Again I think it depends on the crime as to whether or not the parent should take some of the blame... For the instance I gave you before, the parents had tried everything, they had tried punishing those 2 boys repeadedly, but these boys would not even allow their punishments, they would break windows to get out of the house, the parens had tried putting them into a home for "badboys" and they were too much trouble for that place, so for these parents, no I don't think so, because they tried to handle it... some people are just evil and they are born that way. Now when the child is bad due to their envirnment, the parents are teaching the "bad" things, then yes, I think the parents should be held responsible also.

I know that when one of my boys was around 5 or so, he stole a little stuffed animal from the store, I didn't see the toy until we got home. So, almost immediately we went back to the store, I marched him in and up to the customer service counter and made him tell them what he did. They talked to him and scared the crap out of him with going to jail. Needless to say, they did not punish him, but scared him. So as far as I know, he's never done anything like that again.

I was going to post something to that fact as well, my daughter did the same with a candy bar, I took her into the store and made her apologize to the clerk, he looked at me like I was crazy though lol, I don't think she has done it anymore either, but to be safe when she has to go to the bathroom while on the road, I go with her.

I think for violent crimes, such as a punch in the face not in self defense and upward, all human beings should be charged as adults. And I don't think there should be such a thing as misdemeanor assault, it seems like a contradiction in terms, just like if there was such a thing as misdemeanor rape, that would be thought of as a contradiction in terms. The penalty for any violent crime should begin at 10 years in prison. The penalty for violent crime should always be higher than for stealing, but of course they are not because the illuminati made our laws and what they want is for there to be mayhem, so go ahead and beat the shit out of eat other it is just about legal, and then one day it will become a problem and you will react wanting a solution and that will give them the excuse to lock down. And in the mean time at least you are killing each other off with all of your clock outs. And oh yeah as far as stealing, now you are hitting the illuminati where it hurts so none of that shit. Are you all beginning to follow, or are you all just a bunch of too dumbed down humans and have been all acclimated to the idea that punching ppl out is a minor event?

I wish I could remember their names or something like that, it would probably be a good case for you to study. You could probably go on the internet and type in 2 boys that tortured smaller boy or something like that and pull up their story. They really did a number on the little boy (I think the little boy they tortured/killed was like 3 or 4). the things they did to him were absolutely horrible and sikenning. I remember thinking "little boys shouldn't even think of doing things like that" and I really felt for the tortured little boy's family, knowing what that poor thing went through.

calling someone up to 18 year old a child is moronic.

I broke his nose hiding I was the one charged and put on probation LOL! He was let go and told not to come to my house again, even though he was BREAKING in. whatever

Re: Survey, Do you think children under the age of 18 should be tried as adults?
I do not. Age 18 is probably a time in our lives we are the dumbest we'll ever be, but we're expected to make good judgements in major areas of our life. Most still live at home at this age, and haven't even experienced life.

Everyone matures differently and at different times. The difference between age 18 and 28, is astounding.

I'm sure you know what I think about trying 12 & 15 year olds as adults.
 Quoting: Anonymous Coward 25225980

Yes, but by the age of 6 or so they know (or SHOULD!) that it's wrong to take things which don't belong to them, or beat up on other kids. By age 8 they have probably experienced a pet or a relative dying on them, so they know that it's wrong to torture and kill either animals or people.

We tend to look at these things through the filter of our own upbringing. We have to remember that "that was then, and this is now". Kids today are a lot more knowledgeable (and not in a good way) about evil thanks to the 24-hour-per-day TV, Internet, and violent video games. They CERTAINLY know a LOT of "nasty" words, (some of which I never even HEARD until I was past 18), and they don't hesitate to use them, either! They are also well aware of "Childrens' Services Division", and threaten to call and report their parents should the parents deny them whatever they want at the moment. I'd say that a modern 12-year-old is about the equivalent of a 16-year-old back when WE were kids - parents didn't even have "The Talk" until we were 11 or 12, and now we see 8-year-olds raping (and even killing) 2 or 3-year old little toddlers. We hear about 12-year-olds murdering their parents, burning down houses and schools, or desiring to commit a Columbine-type rampage against their schoolmates and teachers. Recently we saw a beautiful young girl who was kidnapped, raped and murdered by a couple of young boys for her BICYCLE. They showed no remorse or guilt when apprehended after the Mother of one of them turned them in.

I guess my answer would be, it depends upon the crime, and the resulting psychological evaluation of the perpetrator. I would also factor in the level of remorse - some young people nowadays are just psychopaths and should be locked up for the rest of their lives.

Well, their "parenting" history should certainly be examined, for the benefit of their OTHER children! However, thanks to the Progressive/Marxist "feel-good" PC "touchy-feely" laws currently in place, the parents' hands are basically tied so far as disciplining their children is concerned. I'm not in favor of "beating" children, but some transgressions just SCREAM out for a "good sound spanking". Sometimes that is the only way that a youngster will remember that what he/she did was so egregious, or dangerous to themselves or others.

Society says, "Well, they should use some creative punishments". But with both parents working just to survive and pay the bills, the kids are often on their own for hours, with no adult supervision. The parents have no time or energy left for "creativity". And kids are notorious for "not thinking things through" or anticipating the consequences of their actions. Chances are, by the time the kids come to the attention of the Authorities the parents HAVE tried every avenue of discipline which they are allowed to, with little to no result.

16 sounds more like a realistic age generally.. However, younger for more serous crimes such as murder. I'm sorry, but you don't have to be a "legal adult" to know and understand the consequences. Stop babying the population and quit this fabled "children" age limit.

Re: Survey, Do you think children under the age of 18 should be tried as adults?
16 sounds more like a realistic age generally.. However, younger for more serous crimes such as murder. I'm sorry, but you don't have to be a "legal adult" to know and understand the consequences. Stop babying the population and quit this fabled "children" age limit.

Agreed again, but what if a 4 year old murders their parents, maybe by accident, and the child cant stand up for themselves? What I mean is what if the parent is not watching them, you're a single parent or the other parent is at work or whatever, and the child gets a knife (we all know how kids like playing with that kind of stuff) Mommy/daddy accidently walks around the corner too fast and the kid is standing there with the knife and BAM, you've been stabbed, and are bleeding out on the floor. Daddy/Mommy comes home, or that concerned neighbor comes over and sees you laying on the floor dead. Foresics show that your child used the knife..... WHat then? hiding

I am taking classes in Criminal Justice and I need to make a survey asking if children under the age of 18 should be tried as adults, so....... should they or shouldn't they?

If a 3 year old hits another 3 year old, he should be tried for assault. You would try an adult so why not this little punk?

That is when the parents need to step in and give the little punk a spanking. While he/she is weeping and wailing, they need to be asked "How does it feel? How much this is hurting you is how much it hurt that other little kid. Do you LIKE how this feels? Maybe you'll remember this the next time you think about beating up on another little kid." Then something needs to be taken away, a toy or a privilege, something which the perpetrator VALUES, not to be given back until he/she spontaneously demonstrates some sort of kindness or consideration for someone else, showing the lesson has been learned.

yes. There should be NO exemptions for juveniles.

Only if they know there is something to fear, I would think most children act before even thinking that anything bad may happen because of their actions. No children should be charged as adults for this reason. They do not think like adults.

The fear that should be given to a child should be from the parent. The parent needs to talk to the child tell them what happens when they do something wrong. If your child is still continuing the crimes by the time they are 15-16 then they should have higher fears from the athorities. Why else is there a juvenile justice system?

no

and I also think its absurd to selectively pick which child you are going to try as an adult.

the rule and law should be in stone, regardless.

otherwise what is the point of a law if it can be manipulated.

Re: Survey, Do you think children under the age of 18 should be tried as adults?
I know that when one of my boys was around 5 or so, he stole a little stuffed animal from the store, I didn't see the toy until we got home. So, almost immediately we went back to the store, I marched him in and up to the customer service counter and made him tell them what he did. They talked to him and scared the crap out of him with going to jail. Needless to say, they did not punish him, but scared him. So as far as I know, he's never done anything like that again.

This is an example of "good" parenting, one which was prevalent when WE were growing up in the 50's, 60's, and even 70's. I can remember MY Mother telling all of the neighbor moms (in front of me, of course) that if they observed me being naughty they could discipline me, and then she wanted them to call her and I would be FURTHER disciplined when I got home. The same with all of my teachers. But now, the "BIG" punishment seems to be "time-out", which teaches absolutely NOTHING other than a kid can get away with basically ANYTHING and all it will cost is a few minutes-worth of sitting in a chair. BFD. No wonder we have so many little reprobates running around! About the time most kids start Kindergarten, modern parents seem to abandon them to the schools to teach them ethics, morals, and responsibility. Unfortunately, the teachers and other adults in the school system aren't allowed to discipline the kids either, so they basically pass them on so that they will become someone ELSE'S problem.

Yes, but the parents are the ones to make them this way, no? The child is not the ones going out and buying the game or the gory movies for themselves, the parents are. Why put the blame on the child for this?
