could they not do the same this time around? It is (or it SHOULD BE, anyways) as easy as saying
Back in 02 when 9/11 was still fresh in everyones mind, the US withdrew from the ABM treaty, "With respect to international law, the US must formally withdraw from this treaty to protect our states' rights and the will of the people within those states". After all, withdrawing from a treaty doesn't automatically mean you are against it.
(Of course I'm sure they drafted the treaty so that simple solution becomes nearly impossible to enact)
